RECOMMENDATION:
Recommendation Concerning the Acceptance of a Drainage Easement Located at 5555 West Highway 98 for the Lake Charlene Drainage Improvement Project - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning the acceptance of a Drainage Easement (approximately 0.02 acres) from The District Board of Trustees of Pensacola State College, Florida, for property located at 5555 West Highway 98:

A. Accept the donation of a drainage easement (approximately 0.02 acres) located at 5555 West Highway 98, from The District Board of Trustees of Pensacola State College, Florida, for drainage improvements;

B. Authorize the payment of documentary stamps considering the property is being donated for governmental use for drainage improvements, and the County benefits from the acceptance of this property, which enhances the safety and well-being of the citizens of Escambia County;

C. Authorize the payment of incidental expenditures associated with the recording of the Drainage Easement document; and

D. Authorize the Chairman or Vice Chairman to accept the Drainage Easement as of the day of delivery to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time.

BACKGROUND:
Lake Charlene Subdivision was permitted by Escambia County in January 1974. Subdivision additions started with Bridle Trail Estates (1977), Lake Charlene 2nd Addition (1979), Lake Charlene East plat (1991), Charlene Patio Villas (1991), Lake Charlene Phase III (1992), Lake Charlene Phase II (1993), and Lake Charlene North (1995). The rainfall event of April 29-30, 2014, affected multiple portions of Escambia County, Florida, including reports of heavy rainfall and flooding occurred in the Lake Charlene area, and the Myrtle Grove and Jones Creek areas, extending eastward to Bayou Chico.

The Lake Charlene project goal is to reduce flooding in the Lake Charlene Subdivision. This will be accomplished by lowering Lake Charlene, removing an existing sluice gate, and constructing a new overflow structure. A 60" stormwater pipe will be installed under Highway 98. Easements from Pensacola State College and Lake Charlene Homeowners Association are needed for construction and maintenance activities. This Drainage Easement, obtained from Pensacola State College, is needed to install rip-rap to prevent the stormwater from eroding the branch leading to Jones Creek, while also decreasing the turbidity and being an energy dissipator. The project is funded by an HMGP grant.

LEGAL CONSIDERATIONS/SIGN-OFF:
The Drainage Easement was approved as to form and legal sufficiency by the County Attorney's office.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139 of the County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will proceed in compliance with Section 46-139 of the County Code of Ordinances.
