Recommendation Concerning the First Amendment to the Economic Development Transportation Project Fund Agreement Relating to the Construction of Transportation Facility Improvements for the Muscogee Road Freight Corridor Along County Road 184 (Muscogee Road), from Beulah Road to Carlisle Drive - Joy D. Blackmon, P.E., Public Works Department Director
That the Board take the following action concerning the First Amendment to the Economic Development Transportation Project Fund Agreement, relating to the construction of transportation facility improvements for the Muscogee Road Freight Corridor along County Road (CR)184 (Muscogee Road), from Beulah Road to Carlisle Drive:
A. Approve and authorize the Chairman to sign the First Amendment to the Economic Development Transportation Project Fund Agreement;
B. Adopt and authorize the Chairman to sign the Resolution supporting the First Amendment to the Economic Development Transportation Project Fund Agreement; and
C. Authorize the Chairman to sign any other documents associated with time extensions, subject to Legal sign-off, and without further action of the Board. |
On October 31, 2016, the Florida Department of Transportation (FDOT) and Escambia County entered into an Economic Development Transportation Project Fund Agreement (EDTFA), Financial Project Number 437039-2-54-01, whereby FDOT agreed to provide Escambia County with financial assistance in the amount of $1,674,000, relating to the construction of transportation facility improvements for the Muscogee Road Freight Corridor along CR 184 (Muscogee Road) from Beulah Road to Carlisle Drive.
FDOT and Escambia County have determined that it is in the best interest of both parties to amend the Agreement to include additional funding as follows:
- Recital A of the Agreement is amended to include the following:
- "The Fiscal Year 2017-2018 General Appropriation Act, Chapter 2017-70, Laws of Florida, provides the Agency with an appropriation of $500,000.00 from the amount in Specific Appropriation 1921A, Local Transportation Projects for Muscogee Road Freight Corridor Improvements - Escambia".
- Recital B of the Agreement is amended by deleting the first sentence and inserting the following:
- "This Agreement provides the conditions necessary for the release of the funds appropriated to the Agency by Chapter 2016-66, Laws of Florida, and 2017-70, Laws of Florida."
- Recital C of the Agreement is amended by deleting the amount "$1,674,000.00" and inserting "$2,174,000.00".
- Recital D of the Agreement is deleted in its entirety and the following is substituted in lieu thereof:
- "FDOT is prepared to provide $1,674,000.00 under Financial Project Number 437039-2-54-01 and $500,000.00 under Financial Project Number 437039-2-54-02 toward the cost of the Project as set forth in Section 6.0 of the Agreement and the Schedule of Funding in Exhibit "B", which is attached and incorporated in this Agreement."
- Section 2.0 of the Agreement is amended by deleting the date "December 31, 2017" in the first sentence, and inserting "April 30, 2018".
- Section 3.0 of the Agreement is amended by deleting the date "October 31, 2017" in the first sentence, and inserting "April 30, 2018".
- Section 4.0 of the Agreement is amended by deleting the third sentence and inserting the following in lieu thereof:
- "The Project, identified as Financial Management Numbers 437039-2-54-01 and 437039-2-54-02, and the quantifiable, measurable and verifiable units of deliverables are described more fully in Exhibit "A" which is incorporated in this Agreement."
- Exhibits "A", "B", "D", and "E" of the Agreement are replaced with attached Exhibits "A", "B", "D", and "E", which are hereby incorporated into this Amendment and the Agreement.
The Parties further agree that the Fiscal Year 2017 funds allocated to Financial Project Number 437039-2-54-01 shall first be exhausted prior to any reimbursements being made utilizing the Fiscal Year 2018 funds allocated to Financial Project Number 437039-2-54-02. |
