RECOMMENDATION: |
Recommendation Concerning the Acceptance of Three Parcels of Real Property Located on Hollywood Avenue, Godwin Lane, and Massachusetts Avenue - Joy Jones, P.E., Public Works Department Director
That the Board take the following action concerning acceptance, via donation, of three parcels of real property, located on Hollywood Avenue, Godwin Lane, and Massachusetts Avenue:
A. Approve and authorize the Chairman to sign the Donation Agreement between Preferred Materials, Inc., and Escambia County;
B. Accept the donation of the following parcels, via Limited Warranty Deeds:

C. Authorize the County Administrator to execute an IRS Form 8283 and a gift substantiation letter, subject to Legal sign-off; and
D. Authorize the Chairman or Vice Chairman to accept, and execute, the Limited Warranty Deeds and all other documents as necessary to complete the transaction, as of the day of delivery of the Deeds to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time. |
BACKGROUND: |
Preferred Materials, Inc., formerly known as APAC FL, Inc. and APAC-Southeast, Inc., is donating to the county, via Limited Warranty Deed, three pit parcels.
By accepting these parcels, the existing pit properties can be utilized for stormwater management purposes by converting the pits into permitted stormwater ponds. Escambia County has obtained assurances from Florida Department of Environmental Protection that there are no outstanding environmental issues associated with these pits.
Godwin - 2028 ($700,000) Floridian ditch restoration and Godwin Lane pit regional pond.
Massachusetts Avenue and Hollywood Avenue - 2020 ($100,000), 2023 ($350,000) Massachusetts Avenue pit pond, Erress Boulevard drainage easement outfall and Massachusetts Avenue sidewalk project. Hollywood Avenue right of way already drains to this pit. |
BUDGETARY IMPACT: |
The Donor has agreed to pay all costs associated with the recording of the documents. Taxes for the current year are not yet due and payable. A recommendation will be brought before the Board to cancel the taxes as provided in Section 196.28, Florida Statutes, when the donation is complete. |
LEGAL CONSIDERATIONS/SIGN-OFF: |
The Limited Warranty Deeds were approved as to form and legal sufficiency by Stephen West, Assistant County Attorney. The IRS Form 8283 and gift substantiation letter are subject to legal sign-off. |
PERSONNEL: |
All work associated with this request is being done in-house and no additional staff is required. |
POLICY/REQUIREMENT FOR BOARD ACTION: |
Upon Board approval, county staff will proceed in compliance with Section 46-139 of the Escambia County Code of Ordinances. |
IMPLEMENTATION/COORDINATION: |
Upon Board approval, staff will have the Limited Warranty Deeds recorded in the public records of Escambia County, Florida. |
