RECOMMENDATION:
Recommendation Concerning SC 25 Express Scanner Lease Agreement for the Escambia County Development Services Department

That the Board take the following action:
 
A.        Rescind the Board’s prior action on August 18, 2016, awarding a Purchase Order for a 63 month lease to Harris Business Machines for the Development Services Department to lease an SC 25 Express Scanner in an annual amount of $1,579.08, in accordance with the Escambia County Code of Ordinances;
 
B.        Approve the Lease Agreement (Number 25413793) with De Lage Landen Financial Services, Inc. for the Development Services Department to lease an SC 25 Express Scanner a 63 month term commencing on October 12, 2016, and authorize the County Administrator to execute the Agreement; and
 
C.        Approve the issuance of a Purchase Order to De Lage Landen Financial Services, Inc. for the Development Services Department to lease an SC 25 Express Scanner for a 63 month term commencing on October 12, 2016, in an annual amount of $1,579.08 ($131.59) per month.
BACKGROUND:
By Board action on August 18, 2016, the Board previously approved a Recommendation from the Development Services Department awarding a Purchase Order to Harris Business Machines for the 63 month lease of an SC 25 Express Scanner in an annual amount of $1,579.08 ($131.59) per month. 
 
Several months later, it was discovered that the Purchase Order was issued in the name of the wrong entity, and Development Services was unable to process payments to the named Lessor, De Lage Landen Financial, Inc.  In addition, a corresponding Equipment Lease Agreement was not properly executed or processed at the time the Purchase Order was awarded. 
 
As of March 15, 2017, payments were in arrears in the amount of $732.95 to include monthly lease fees (11/15/16-3/15/17) of $657.95 and an initial documentation fee of $75.00.  (The Lessor agreed to waive any accrued late fees.)  In order to resolve the delinquency of the account in the most expeditious manner, the County Attorney’s Office is requesting approval of the Lease Agreement and Purchase Order in the name of the Lessor.  
BUDGETARY IMPACT:
[Funding: Fund 116, Development Review, Cost Center 240302, Development Review Division, Object Code 54401 Rentals and Leases.]

The Lease Agreement was reviewed and approved by Assistant County Attorney, Kristin D. Hual.

IMPLEMENTATION/COORDINATION:
Upon execution of the Agreement and Purchase Order, the necessary documentation will be forwarded to the Clerk’s Office with a request to immediately process a payment in the amount of $732.95.
