Issue:    Acceptance of a Drainage and Access Easement for Greystone Estates Subdivision

RECOMMENDATION:
Recommendation Concerning the Acceptance of a Drainage and Access Easement for Graystone Estates - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning the acceptance of a Drainage and Access Easement (approximately 0.74 acres) Northern Gulf Nowak, LLC, for Graystone Estates from:

A. Accept the donation of a Drainage & Access Easement (approximately 0.74 acres) from Northern Gulf Nowak, LLC, for Greystone Estate ;

B. Authorize the payment of incidental expenditures associated with the recording of documents; and

C. Authorize the Chairman or Vice Chairman to accept the Easement, as of the day of delivery of the Easement to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time.

BACKGROUND:
Greystone Estates is currently going through the Development Review Committee (DRC) Process. Phase I has already been approved, but the rights-of-ways were not platted with Phase I. They will be platted in Phase II, which is under review by DRC. 

During Phase I, because two dry retention ponds (Parcels "AA" and "BB") were platted behind Block "C" and "D", without any right-of-way, the County cannot access them. This 80' drainage and access easement, which will be located off Upland Road, is necessary for access to the county ponds and the overflow discharge pipe from the ponds.
BUDGETARY IMPACT:
Funds for incidental expenses associated with the recording of documents are available in an Engineering Escrow Account accessed by the Clerk's Office.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Drainage & Access Easement was approved as to form and legal sufficiency by the County Attorney's office.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139, Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will proceed in compliance with Section 46-139 of the County Code of Ordinances.
