RECOMMENDATION:
Recommendation Concerning the Acceptance of a Portion of Real Property for Magaha Lane Right-of-Way - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning the acceptance of the donation of a portion of real property for Magaha Lane right-of-way, from Bright-Meyers-Sasser Westside, LLC:

A. Accept the Special Warranty Deed, from Bright-Meyers-Sasser Westside, LLC, donating a portion of real property along Magaha Lane for right-of-way; and

B. Authorize the Chairman or Vice Chairman to accept the Special Warranty Deed as of the day of delivery of the Special Warranty Deed to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time.

BACKGROUND:
Magaha Lane runs parallel with East Nine Mile Road; Westside Drive connects East Nine Mile to Magaha Lane.

It was discovered during the Development Review Committee (DRC) process that the existing, underground utilities on the northern boundary of Magaha Lane were actually located on the private parcel being developed. Bright-Meyers-Sasser Westside, LLC, is willing to donate this area, 0.024 acres, to the county so that underground utilities can be contained within the public right of way of Magaha Lane.
BUDGETARY IMPACT:
Funds associated with the recording of this document are available in the Engineering Escrow Account.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Special Warranty Deed was approved as to form and legal sufficiency by Stephen West, Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
Upon Board approval, county staff will proceed in compliance with Section 46-139 of the Escambia County code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will have the Special Warranty Deed recorded in the public records of Escambia County, Florida.
