RECOMMENDATION:
Recommendation Concerning the Conveyance of a Temporary Construction Easement and Portion of County-Owned Right-of-Way to the Florida Department of Transportation for the Signal and Intersection Improvements to State Road 10A (U.S. 90/Mobile Highway) at County Road (CR) 99 (Beulah Road) - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning the conveyance of a Temporary Construction Easement to the State of Florida Department of Transportation (FDOT) and County Deed between Escambia County and FDOT, for their planned improvement project at the intersection of State Road (SR) 10A (U.S. 90/Mobile Highway) at County Road (CR) 99 (Beulah Road):

A. Adopt the Resolution authorizing the temporary use by FDOT of certain lands now owned by Escambia County for FDOT's planned improvement project to construct or improve SR 10A (U.S. 90/Mobile Highway), Financial Project No. 4367241, in Escambia County, Florida;

B. Approve the Temporary Easement by and between Escambia County and FDOT;

C. Adopt the Resolution for the conveyance of a portion of County-owned right-of-way to FDOT (approximately 814 square feet) for their planned improvement project for the portion of SR 10A (U.S. 90/Mobile Highway) at CR 99 (Beulah Road);  

D. Approve the County Deed authorizing the conveyance of land to FDOT; and

E. Authorize the Chairman or Vice Chairman to execute the Easement, Resolutions, Deed, and all other documents related to the conveyance, subject to Legal review and sign-off, without further action of the Board.

All costs associated with accepting and recording of documents will be borne by FDOT.
BACKGROUND:
FDOT is planning a signal and intersection improvement project located at SR 10A (US 90/Mobile Highway) at CR 99 (Beulah Road) intersection. The improvements will include a traffic signal and the addition of new turn lanes. The requested right of way will be used for signal pole placement. The Temporary Construction Easement area will be used to tie in the existing roadway with the new turn lanes at the intersection. The requested Temporary Construction Easement will expire upon completion of the roadway project.
BUDGETARY IMPACT:
All costs associated with accepting and recording of documents will be borne by FDOT.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Temporary Construction Easement, Resolutions, and County Deed were approved as to form and legal sufficiency by Stephen West, Senior Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
Upon Board approval, county staff will proceed in compliance with Section 46-139 of the Escambia County code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will maintain compliance with Section 46-139 of the Escambia County Code of Ordinances.
