RECOMMENDATION:
Recommendation Concerning the Acceptance of Two Drainage Easements for the Beulah Road Drainage Improvement Project - Joy D. Blackmon, P.E., Public Works Department Director 

That the Board take the following action concerning the acceptance of the donation of two drainage easements for the Beulah Road Drainage Improvement Project:

A. Accept the donation of the following two drainage easements located in the Beulah area for the Beulah Road Drainage Improvement Project:

B. Authorize the payment of documentary stamps because the properties are being donated for governmental use, which is for drainage improvements, and the County benefits from the acceptance of these properties, which enhances the safety and well-being of the citizens of Escambia County;

C. Authorize the payment of incidental expenditures associated with the recording of documents; and 

D. Authorize the Chair or Vice Chair to accept the Easements as of the day of delivery of the Easements, and for the Chair or Vice Chair to acknowledge the Board's acceptance at that time.

BACKGROUND:
During heavy rain events, stormwater runs off Beulah Road and drains from the surrounding neighborhood to a headwall on the east side of the road, flows into an existing ditch alongside a private pond, and drains to an existing holding pond on the northeast side of the property. Over time, the capacity of flow has overwhelmed the ditch and has caused erosion problems, which in turn has caused flooding to Mr. and Mrs. Morgan's property located at 8510 Beulah Road. In order to resolve the flooding on the property and reduce future erosion to the drainage ditch, it is proposed to improve the ditch with a tied concrete block system to insure proper flow and discharge to the existing rear holding pond. The 40' wide Drainage Easements will allow for the improvements to better convey the stormwater and help to prevent further erosion. In order to properly maintain the area, a 654' gravel road will be installed from Beulah Road down the entire length of the easement.  A gate will be installed off Beulah Road and at the northeast limits of the easement to permit access.  Once Easements are accepted, construction is projected for April - July, 2017.
BUDGETARY IMPACT:
Funds for incidental expenses associated with the recordings of documents are available in an Engineering Escrow Account accessed by Escambia County Clerk's Office.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Drainage Easements have been signed approved as to form and legal sufficiency by the County Attorney's Office.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139, Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will proceed in compliance with Section 46-139 of the County Code of Ordinances.
