RECOMMENDATION:
Recommendation Concerning HESI/Transocean Punitive Damages & Assigned Claims Settlements Form

That the Board take the following action:

A. Approve the HESI/Transocean Punitive Damages & Assigned Claims Settlements Form; and

B. Ratify the execution of the form by the County Administrator.
BACKGROUND:
By submitting the proposed claim form with supporting documentation, Escambia County may be eligible to receive settlement funds from the HESI/Transocean Punitive Damages & Assigned Claims Settlements Program for damages sustained by sixteen coastal properties owned by the County at the time of the oil spill incident in 2010.  The claim form, which was previously executed and timely submitted, was due no later than December 15, 2016.
 
The HESI/Transocean claim will be pursued on behalf of the County by the law firm of Levin, Papantonio, Thomas, Mitchell, Rafferty, and Proctor, P.A., in accordance with the terms of the Engagement and Contingency Fee Agreement, dated December 12, 2011.  As provided in the Agreement, the County will not be under any obligation to pay any attorneys’ fees or costs unless a recovery is made, and the applicable fee shall be an 18% contingency fee of any recovery obtained.
