RECOMMENDATION:
Recommendation Concerning Derelict Vessel Removal Grant Agreement with Florida Fish and Wildlife Conservation Commission - J. Taylor “Chips” Kirschenfeld, Director, Department of Natural Resources Management

That the Board approve and authorize the Chairman to sign the State of Florida, Florida Fish and Wildlife Conservation Commission (FWC) Agreement No. 16175 relating to the Derelict Vessel Removal Grant for Fiscal Year 2016-2017, which provides $7,650 Grant funding from FWC combined with Escambia County’s $2,550 cash match for a total cost of $10,200 to remove and dispose of the two eligible derelict vessels, based on price quotes that were obtained as required in the Grant Application.
 
Note:  The County Attorney's Office has requested that the Board be made aware of the following language:

* Paragraph 30, SEVERABILITY, CHOICE OF LAW, AND CHOICE OF VENUE, (page 19 of 22), last sentence, "Any action in connection herewith, in law or equity, shall be brought in Leon County, Florida, to the exclusion of all other lawful venues."

* Paragraph 32, JURY TRIAL WAIVER, (page 19 of 22), "As part of the consideration of this Agreement, the Parties hereby waive trial by jury in any action or proceeding brought by any Party against any other Party pertaining to any matter whatsoever arising out of or in any way connected with this Agreement, or with the products or services provided under this Agreement, including but not limited to any claim by the Grantee of quantum meruit."

BACKGROUND:
At the 9/22/2016 BCC meeting,the Board authorized the County Administrator to sign a Derelict Vessel Removal Grant Application to the Florida Fish and Wildlife Conservation Commission (FWC), with local matching of in-kind services and up to $50,000 from Vessel Registration Fees. As required for the Grant Application, Marine Resources Division obtained price quotes for the two eligible derelict (declared “derelict” by FWC Law Enforcement) vessels in the waters surrounding Escambia County. These price quotes were submitted to FWC with Escambia County’s Grant Application requesting $7,650 grant funding, with Escambia County providing $2,550 cash match, for a total cost of $10,200 to remove and dispose of the two eligible derelict vessels.

The Grant Agreement was reviewed and approved, as to form and legal sufficiency, by Kristin Hual, Assistant County Attorney.

IMPLEMENTATION/COORDINATION:
epartment of Natural Resources Management, Marine Resources Division, will continue coordination with FWC on all activities associated with the Grant Agreement.
