RECOMMENDATION:
Recommendation Concerning Acceptance of a Special Warranty Deed and a Drainage Easement from Pine Brook Northwest Unplatted Subdivision - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning acceptance of a Special Warranty Deed and a Drainage Easement from Pine Brook Northwest Unplatted Subdivision:

A. Accept a Special Warranty Deed and a Drainage Easement from Pine Brook Northwest Unplatted Subdivision;

B. Authorize the payment of documentary stamps because the property is being donated for governmental use for drainage improvements and the county benefits from the acceptance of this property, which enhances the safety and well-being of the citizens of Escambia County;

C. Authorize the payment of incidental expenditures associated with the recording of documents; and

D. Authorize the Chairman or Vice Chairman to accept the Warranty Deed and Easement as of the day of delivery of the Easements to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time.

BACKGROUND:
Pine Brook Northwest Unplatted Subdivision is a single family residential subdivision (11.71 acres and 5 proposed lots) located on Carmody Hill Road (off Highway 297A). 

In regards to the Special Warranty Deed:  During the Development Review Committee (DRC) process, it was discovered that Parcel A and Parcel B were needed by Escambia County. Acceptance of the Special Warranty Deed for Parcel A will allow the county access to the pond and to a natural drainage route from the lake. Parcel B will provide county ownership over an existing drainage inlet.

In regards to the Drainage Easement: a proposed 30' drainage easement will extend access from Parcel A to the pond, and will also provide a drainage easement over a portion of Lot 89 (Pine Brook Estate, unrecorded), over an existing drainage structure.  

Pine Brook Northwest Unplatted was approved by DRC on September 28, 2016, with a Special Condition stating that no land disturbing permits, land use permits, building permits, or conveyance of lots will take place prior to BCC approval and acceptance of the Drainage Easements and Parcels A & B.
BUDGETARY IMPACT:
Funds for incidental expenses associated with the recording of documents are available in an Engineering Escrow Account accessed by the Escambia County Clerk's Office.
LEGAL CONSIDERATIONS/SIGN-OFF:
The documents associated with this project will be subject to Legal signoff by the County Attorney's office.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139, Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will proceed in compliance with Section 46-139 of the County Code of Ordinances.
