RECOMMENDATION:
Recommendation Concerning the Acceptance of an Encroachment Agreement from Gulf South Pipeline, LP, for the Dirt Road Paving and Drainage Improvements for Killam Road - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning acceptance of an Encroachment Agreement from Gulf South Pipeline, LP, for the dirt road paving and drainage Improvements for Killam Road:

A. Accept the Encroachment Agreement from Gulf South Pipeline, LP, for dirt road paving and drainage Improvements for Killam Road;

B. Authorize the payment of incidental expenditures associated with the recording of documents; and

C. Authorize the Chairman or Vice Chairman to sign the Encroachment Agreement.

BACKGROUND:
This recommendation is for the acceptance and issuance of an Encroachment Agreement from Gulf South Pipe Line for the dirt road paving and installation of drainage improvements on Killam Road from State Road 4-A to Stateline Road. The agreement is required due to the Gulf South Pipeline right of way which crosses Killam Road.

This portion of Killam Road is approximately 4,500 linear feet in length. The improved two-lane roadway section will consist of 11-foot wide lanes, 2-foot grassed shoulders with roadside ditches, and paved residential driveways.
 
Drainage improvements will include a new cross-drain, new driveway culverts as necessary, armoring of 2,900 linear feet (LF) of roadside ditches and stormwater inlets, and the addition of 1,700 LF of subsurface storm piping.
 
The contract bid amount is $1,015,163.25, which will be funded through the Local Option Sales Tax (LOST) III Dirt Road Paving Program. 
 
The expected construction contract length is 180 days, with construction anticipated to start in January 2017.
 
BUDGETARY IMPACT:
Funds are available in Fund 352 "LOST III", Cost Center 210107, Object Code 56301, Project #08EN0068.
LEGAL CONSIDERATIONS/SIGN-OFF:
The encroachment agreement has not been signed off by the County Attorney's Office due to concerns about the terms set forth by Gulf South Pipeline, including indemnity and attorney's fees provisions required by Gulf State Pipeline.  The County Attorney can address these concerns for the Board at its meeting.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.

IMPLEMENTATION/COORDINATION:
Upon Board approval of the Encroachment Agreement, construction of the project will proceed as scheduled.
