RECOMMENDATION:
Recommendation Concerning Acquisition of Real Properties for the Bristol Park - Ashbury Hills Area Project - Joy D. Blackmon, P.E., Public Works Department Director

That the Board consider the purchase of real properties located in the Bristol Park - Ashbury Hills Area for the Hazard Mitigation Grant Program (HMGP):

A. Authorize staff to pursue the acquisition of properties listed in the HMGP Grant, specifically located along the creek bank of Eleven Mile Creek;

B. Authorize staff to pursue property acquisition from other willing owners, specifically located along the creek bank of Eleven Mile Creek, and not listed in the Grant Agreement, by first seeking Scope of Work amendments to Federally-Funded Subgrant Agreement, Project Number 4177-08-R, Agreement #16HM-H4-01-27-01-452, from the State of Florida, Division of Emergency Management (FDEM);

C. Authorize staff to continue with the purchase procedures as outlined in Section 46-139 of Escambia County Code of Ordinances and consistent with FEMA acquisition requirements;

D. Authorize staff to prepare contracts for consideration and final approval by the Board.

BACKGROUND:
Meeting in regular session on June 16, 2016, the Board approved the Hazard Mitigation Grant Program (HMGP) Agreement for Project Number 4177-08-R. The HMGP Agreement requires mitigation for properties located within a 100-year special flood hazard zone that includes acquisition and demolition. This project will eliminate historical flooding at the above addresses by removing the structures and converting these lands to deed-restricted open spaces that will allow flood water to be naturally stored on the properties. This project is part of a comprehensive approach to mitigate flooding issues and restore the floodplain in the Bristol Creek, Bristol Park, and Ashbury Hills area of Eleven Mile Creek.

Staff has corresponded with FDEM to amend the Scope of Work, as stated in the awarded Federally-Funded Subgrant Agreement, Project Number 4177-08-R. Scope amendments requested of FDEM will add additional properties adjoining Eleven Mile Mile Creek to the grant agreement, as well as reallocate acquisition/demolition funds for properties listed in the agreement, from properties not adjoining the creek to those adjoining the creek. Said scope of work amendments will provide more effective use of federal funds, by utilizing the identified properties, funded by the HMGP grant, for stream restoration and flood plain expansion of Eleven Mile Creek. The overall project goal is to effectively reduce the flood stage in Eleven Mile Creek to improve flood protection of homes and properties within the area of Bristol Park and Ashbury Hills subdivisions.

In order to comply with the FEMA regulations concerning acquisition, staff will be sending certified offer letters to residents which will be based off the appraised value of the property.  Additionally, there are time restraints associated with the acquisition portion of this grant.  Demolition of structures on properties acquired by the County must happen within 90 days from closing.
BUDGETARY IMPACT:
Fund 352 “LOST III”, Cost Center 210120, Object Code 56101, Project #16EN3595.  Funds spent toward this project are eligible for reimbursement through the grant.
LEGAL CONSIDERATIONS/SIGN-OFF:
Legal review will be accomplished throughout the acquisition process and all required approvals from the Legal Department will be obtained, as required.

These actions are consistent with the provisions of Section 46-139 of the Escambia County Code of Ordinances.
