RECOMMENDATION:
Recommendation Concerning the Conveyance of a Utility Easement and Deed to Emerald Coast Utilities Authority for Upgrades to Lift Station #56 - Joy D. Blackmon, P.E., Public Works Department Director 

That the Board take the following action concerning the conveyance of a utility easement and Deed to Emerald Coast Utilities Authority (ECUA):

A. Approve the 20-foot wide utility easement, which extends from Winding Lane to the lift station site at the northwest corner of Scenic Highway and Olive Road;

B. Adopt the Resolution authorizing the conveyance, by Deed, of the property that immediately surrounds the lift station area; and  

C. Authorize the Chairman or Vice Chairman to sign the necessary documents granting the Utility Easement and Deed to ECUA.

[Funding source:  All costs associated with accepting and recording of documents will be borne by ECUA]
BACKGROUND:
ECUA has a lift station located on a small parcel of property which is surrounded by a large County-owned parcel (05-1S-29-1004-000-000), at the northwest corner of Scenic Highway and Olive Road. ECUA has plans to make improvements to the sanitary system in that area, including replacing the existing lift station (LS #56) and rerouting some underground piping. LS #56 is currently located on a 40 foot by 40 foot parcel, which will not accommodate the proposed upgrades. In order to complete this project, ECUA is requesting a 20-foot wide utility easement, which extends from Winding Lane to the lift station site, as well as a portion (approximately 11,475 square feet) of the County-owned parcel.
BUDGETARY IMPACT:
All costs associated with accepting and recording of documents will be borne by ECUA.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Deed, Resolution, and Utility Easement were approved as to form and legal sufficiency by Stephen West, Senior Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the requirements of Section 46-139, Escambia County Code of Ordinances and Section 125.38, Florida Statutes.
IMPLEMENTATION/COORDINATION:
Upon Board approval and execution of the documents by the Chairman, staff will transfer the documents to ECUA for acceptance and recording in the public records of Escambia County, Florida. County staff will continue to coordinate with ECUA in meeting their requirements for this easement.
