RECOMMENDATION:
Recommendation Concerning the Acceptance of Baywalk Subdivision Retention Area for Permanent Maintenance, Funded Through the Establishment of a Stormwater Management Municipal Services Benefit Unit - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning the acceptance of the donation of a parcel of real property, a platted retention area, located in the Baywalk Subdivision: 

A. Accept the retention area as depicted on Plat Book 14, Page 17 (a 0.10 acre dry retention pond) for permanent County maintenance; the cost of maintenance for drainage improvements is to be funded through the establishment of a stormwater management Municipal Services Benefit Unit (MSBU); and

B. Authorize the Chairman or Vice Chairman to accept the Special Warranty Deed as of the day of delivery of the Deed to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time.
BACKGROUND:
Baywalk Subdivision, built in 1989, is a 10-lot residential subdivision located off of Scenic Highway. All streets and drainage easements within the subdivision were dedicated to the County upon approval of the final plat on June 27,1989, but the retention area remained private. The retention area has had several different owners over the years. By the time CharterBank took ownership in September of 2011, the retention area was in need of repair.  

After multiple complaints from Baywalk Subdivision residents regarding the improper draining of associated stormwater inlets, the County investigated the pipe and determined it to be clogged with dirt and debris at the outfall in the private pond. Florida Department of Transportation staff also reported that the drainage system was discharging uncontrolled runoff to Scenic Highway (SR 90.)

In February of 2015, Escambia County Development Services Department staff sent a letter to CharterBank in an effort to have the complaints addressed and to relay the findings of the investigation. Upon receipt of the letter, CharterBank approached the County with the possibility of the County accepting the pond for maintenance. Kenneth Horne & Associates, Inc., was hired by CharterBank to provide a design for pond improvements, and a stormwater permit was issued by the County for the required improvements. The pond now meets satisfactory condition as per the last inspection performed in May 2016, and has been certified by the Engineer of Record as complete and ready for acceptance.  
BUDGETARY IMPACT:
The Office of Management and Budget will establish an MSBU assessment for maintenance.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Special Warranty Deed was approved as to form and legal sufficiency by Stephen West, Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
Upon Board approval, County staff will proceed in compliance with Section 46-139 of the Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon board approval, staff will provide the executed Warranty Deed to Locklin, Saba, Locklin & Jones, P.A., who will have the Warranty Deed recorded in the public records of Escambia County, Florida.
