RECOMMENDATION:
Recommendation Concerning the Acceptance of a Portion of a Parcel of Real Property Located on Havburg Drive for Roadway and Drainage Improvements - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning the acceptance of the donation of a portion of a parcel of real property  located on Havburg Drive, from property owners Havburg Terrace, for roadway and drainage improvements:

A. Authorize staff to negotiate and resolve any matters related to, or associated with, the acceptance of the donation of a portion of real property, via donation, for roadway and drainage improvements located on Havburg Drive, from property owners Havburg Terrace; 

B. Authorize the payment of documentary stamps because the property is being donated for governmental use, which is for roadway and drainage improvements, and the county benefits from the acceptance of the property because it facilitates the construction and maintenance of paving and drainage systems for use by the citizens of Escambia County;

C. Authorize the payment of incidental expenditures associated with recordings of documents; and

D. Authorize the Chairman or Vice Chairman to accept the Quitclaim Deeds as of the day of delivery of the Quitclaim Deeds to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time.

BACKGROUND:
Havburg Drive is located in District 1 and runs east off of Bauer Road for approximately 770 feet, at which point county maintenance terminates and the road becomes privately maintained. At the terminus of county maintenance, there is a low point in the road where water stands, which creates potholes and recurring maintenance issues. The acquisition of this parcel of property will allow for roadway and drainage improvements to be constructed, thus eliminating the recurring pothole and standing water issues.

Title to the property is uncertain.  Staff has obtained quitclaim deeds from people who may likely have an interest in the property, but there are almost certainly other unknown interests that the county may have to acquire in the future.
BUDGETARY IMPACT:
Funds for incidental expenses associated with recording of documents are available in an Engineering Escrow Account accessed by the Escambia County Clerk's Office.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Quitclaim Deeds were approved as to form and legal sufficiency by Stephen West, Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
Upon Board approval, county staff will proceed in compliance with Section 46-139 of the Escambia County code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, the Quitclaim Deeds will be recorded in the public records of Escambia County, Florida.
