RECOMMENDATION:
Recommendation Concerning Contract Award Willowbrook Lake Dam Reconstruction Project - Paul Nobles, Purchasing Manager, Office of Purchasing

That the Board take the following action:

A. Rescind the Board’s action of February 21, 2019, CAR II-17, approving the Agreement between Escambia County, Florida, and Panhandle Grading & Paving, Inc., per the terms and conditions of PD 18-19.013, Willowbrook Lake Dam Reconstruction Project; and    

B. Approve and authorize the Interim County Administrator to sign the Agreement between Escambia County, Florida, and Panhandle Grading & Paving, Inc., per the terms and conditions of PD 18-19.013, Willowbrook Lake Dam Reconstruction Project, in the amount of $1,157,915.53.

BACKGROUND:
Willowbrook Lake is located in District 5, south of Kingsfield Road, north of Ten Mile Road, east of US 29, west of Chemstrand Road, and serves as a storm water retention pond for this area. 

The dam and outfall structure at Willowbrook Lake was severely damaged during the April 2014 Rainfall Event and compromised the infrastructure of Chemstrand Road, a major corridor to industries north of Nine Mile Road. The purpose of this project is to reconstruct the dam that will provide stormwater treatment for the area, protect the infrastructure of Chemstrand Road, and protect downstream properties.

The project will include removing and rebuilding the dam with a solid clay core. The project has been designed to meet the current County requirements for stormwater retention, dam structure and all permits have been acquired. 

Construction is anticipated to take approximately 300 days, excluding weather delays.

The Legal advertisement for this "Invitation to Bid" was advertised in the Pensacola News Journal on December 10, 2018.  A mandatory Pre-Solicitation Conference was held on January 3, 2019.  Six firms were represented at that meeting.  Bids were received from five contractors on January 17, 2019. Panhandle Grading & Paving, Inc., is the lowest, most responsive and responsible bidder.

The agreement identified the incorrect contract amount.  $3,785,659.19 was originally identified as opposed to the correct amount of $1,157,915.53.

Funding:  Fund 353, Cost Center 210106, Object Code 56301, Project Number 19EN0525 - $951,089.00; Fund 352, Cost Center 210107, Object Code 56301, Project Number 15EN3325 - $190,814.24; and Fund 352, Cost Center 210107, Object Code 56301, Project Number 14EN2605 - $16,012.29; Total $1,157,915.53.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Agreement is the Standard Form "D" Construction Agreement.
PERSONNEL:
All work associated with this recommendation was done in-house and no additional staff was required.
POLICY/REQUIREMENT FOR BOARD ACTION:
This recommendation is in compliance with the Code of Ordinances of Escambia County, FL 1999, Chapter 46, Finance, Article II Purchases and Contracts.
IMPLEMENTATION/COORDINATION:
The Office of Purchasing will issue the Attorney's Standard Form of Contract Form D: Road/Drainage and Purchase Order.
