RECOMMENDATION:
Recommendation Concerning the Acceptance of a Public Road and Right-of-Way Easement for Silvershore Drive - Joy Jones, P.E., Engineering Department Director

That the Board take the following action concerning the acceptance of the donation of a Public Road and Right-of-Way Easement (approximately 726 square feet) located at 634 1/2 Silvershore Drive from Thomas M. Eiring: 

A. Accept the donation of a Public Road and Right-of-Way Easement located at 634 1/2 Silvershore Drive for road improvements;

B. Authorize the payment of documentary stamps because the property is being donated for governmental use and the County benefits from the acceptance of this property, which enhances the safety and well-being of the citizens of Escambia County;

C. Authorize the payment of incidental expenditures associated with the recording of documents; and

D. Authorize the Chairman or Vice Chairman to accept the Easement as of the day of delivery of the Easement to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time.

This property is located in Commission District 2.

BACKGROUND:
Mr. Eiring has agreed to donate a portion of his property located at 634 1/2 Silvershore Drive for road improvement purposes. Mr. Eiring also owns the property that abuts this property to the south (634 Silvershore Drive). 
 
The donation will allow for the installation of a cul-de-sac at the end of Silvershore Drive, which will also allow the property owner to change the orientation of the existing lots.  By installing the cul-de-sac, fire/life safety vehicles will have a more adequate turn around option.  This project is currently under review by Development Services.
BUDGETARY IMPACT:
Funds for incidental expenses associated with the recording of documents are available in an Engineering Escrow Account accessed by the Escambia County Clerk's Office.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Public Road and Right-of-Way Easement was approved as to form and legal sufficiency by Stephen West, Assistant County Attorney, on March 4, 2019.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
Upon Board approval, County staff will proceed in compliance with Section 46-139 of the Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will have the executed Easement recorded in the public records of Escambia County, Florida.
