RECOMMENDATION:
Recommendation Concerning the State of Florida Department of Transportation Right of Entry Agreement for South Stefani Road Right-of-Way - Joy Jones, P.E., Engineering Department Director

That the Board approve and authorize the Chairman to sign the State of Florida Department of Transportation Right of Entry Agreement for South Stefani Road Right-of-Way.

This Right-of-Way is located in Commission District 3.
BACKGROUND:
Florida Department of Transportation (FDOT) is performing a reconstruction project on SR 10 (US 90A - Nine Mile Road) from SR 297 (Pine Forest Road) to SR 95 (US 29) in Escambia County, under FPID 218605-3-52-01. Escambia County is the owner of Stefani Road, a 30' unopened right-of-way which is adjacent to the ongoing FDOT project. 

The request is for an approved Right of Entry Agreement from Escambia County allowing FDOT's Contractor (Panhandle Grading and Paving) to access the western 20' of the 30' Stefani Road unopened right-of-way, which is approximately 1,550' south of the Nine Mile Road right-of-way. The contractor will utilize the Stefani Road right-of-way to gain access through the private parcel, located to the south of Nine Mile Road and to the west of the Stefani Road right-of-way, to an existing FDOT drainage easement. In the existing drainage easement, FDOT will be removing an existing 72" pipe and constructing double 54" pipes. 

FDOT is currently working with the property owner to acquire another Right of Entry Agreement allowing FDOT to install a 40'  by 40' staging area (laydown area) adjacent to the Stefani Road right-of-way and for access across the private parcel to the existing FDOT drainage easement to perform the necessary drainage work.

FDOT plans to start the drainage work, requiring Stefani Road right-of-way access, on July 22, 2019. The anticipated completion date is November 22, 2019.

Upon completion of the drainage work, FDOT will restore the Stefani Road right-of-way to the condition existing prior to entry - or better. A review with Escambia County staff will be conducted to ensure all parties are satisfied prior to completion of this project.

Legal has reviewed and signed off on the Agreement.
