RECOMMENDATION:

Recommendation Concerning Authorization to Take Action Regarding Defaulted Contracts for Reimbursement of Training Expenses - William R. Powell, Director of Corrections

That the Board take the following action concerning authorization for legal action related to defaulted Contracts for reimbursement of training expenses:

A. Authorize the County Attorney's Office to file a small claims case against John Henshaw and Matthew Lindsey related to the default of their respective Contracts for reimbursement of training expenses; and

B. Authorize the County Attorney's Office to prepare and the Chairman to sign all documents related to the aforementioned action.

BACKGROUND:

On January 10, 2017, John Henshaw and Matthew Lindsey entered into separate agreements with Escambia County. The aforementioned agreements outlined their committments to provide two years of service to the Corrections Department post graduation from the training program. In return, the County would cover the cost of tuition, fees and uniforms associated with the training program. Both gentlemen tendered their resignations prior to fulfilling their two-year commitment. Both gentlemen were provided a 12-month window of opportunity during which they were requested to fulfill the financial obligations of their agreement. As of the date of this recommendation, Mr. Henshaw owes the County $1,953.05 and Mr. Lindsey owes the County $1,438.97.

The County Attorney's Office will prepare or approve all documents prior to execution by the Chairman.

Once authorized, the County Attorney's Office will file the neccessary paperwork related to the small claims cases.
