RECOMMENDATION:
Recommendation Concerning the Scheduling of a Public Hearing to Consider the Vacation of a Portion of Opened Right-of-Way Known as Beulah Road - Joy Jones, P.E., Engineering Department Director

That the Board schedule a Public Hearing for November 7, 2019at 5:32 p.m., to consider the Petition to Vacate a Portion of Opened Right-of-Way Known as Beulah Road, as petitioned by Pate Land Development, Inc., represented by its agent, Frank Fabre: 

A. Authorize the scheduling of a Public Hearing for November 7, 2019, at 5:32 p.m., to consider the Petition to Vacate a Portion of Opened Right-of-Way Known as Beulah Road (0.6 acres, more or less), as petitioned by Pate Land Development, Inc., represented by its agent, Frank Fabre; and

B. Require the Petitioner to notify all property owners within a 1000 foot radius.

The real property mentioned in this Petition to Vacate is located in Commission District 1.
BACKGROUND:
The Petitioner is requesting that the county vacate this portion of Beulah Road for a development planned for Hurst Hammock Road. Access to the development will be from Hurst Hammock Road. If the County agrees to vacate this portion of Beulah Road, the Petitioner will be able to more effectively plat the development. Beulah Road currently dead-ends into their property. Residents will not be impacted by the vacation of this portion of Beulah Road. 

County staff has reviewed this request and has no concerns. Improvements will be required to be reviewed by the County's Development Review Committee for any proposed development of the property.

Utility companies have been notified. There are no facilities in the area outlined by the Petition to Vacate. Gulf Power Company has no concerns but mentioned that the area in question is the end of a single-phase line that can be removed if needed. The Petitioner will need to contact Gulf Power to make arrangements for removal and must agree to allow 3 to 4 weeks to have the work completed.
BUDGETARY IMPACT:

Indirect staff cost associated with the preparation of documents and recommendation.

LEGAL CONSIDERATIONS/SIGN-OFF:

N/A

PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:

Based on the Board’s Vacating, Abandoning, and Closing Existing Public Streets, Rights-of-Way, Alleyways, Roads, Highways, Other Places Used for Travel or Other Lands Dedicated for Public Use or Purposes, or Any Portions Thereof to Renounce and Disclaim Any Right of the County and The Public In and To Said Lands policy for closing, vacating and abandoning County owned property – Section III and Florida Statutes, Chapter 336.

IMPLEMENTATION/COORDINATION:

Once the Public Hearing has been scheduled, the Petitioner will be notified, the date and time will be advertised, and all owners of property within 1000 feet will be notified by the Petitioner or the Petitioner's agent.
