RECOMMENDATION:
Recommendation Concerning the Acceptance of a Drainage Easement Located in the 1100 Block of Bronson Road and Hartung Avenue from Pensacola Christian College, Inc. - Joy Jones, P.E., Engineering Department Director

That the Board take the following action concerning the acceptance of a Drainage Easement (approximately 1.16 acres) located in the 1100 Block of Bronson Road and Hartung Avenue from Pensacola Christian College, Inc.:

A. Accept the donation of a Drainage Easement located in the 1100 Block of Bronson Road and Hartung Avenue for drainage improvements;

B. Authorize the payment of documentary stamps considering the property is being donated for governmental use for drainage improvements, and the County benefits from the acceptance of this property, which enhances the safety and well-being of the citizens of Escambia County;

C. Authorize the payment of incidental expenditures associated with the recording of documents; and

D. Authorize the Chairman or Vice Chairman to accept the Easement on the day of delivery of the Easement to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to acknowledge the Board's acceptance at that time.

BACKGROUND:

The proposed Drainage Easement submitted for acceptance by the Board of County Commissioners is for the purposes of constructing a drainage system to provide positive outfall for a section of Bronson Road. This portion of Bronson Road is approximately 1,700 linear feet south of Lillian Highway.

Following construction and final plat approval of the Reunion Place Subdivision by the Board of County Commissioners on August 16, 2018, staff received several drainage complaints from residents adjoining the east side of Bronson Road, reporting yard flooding from the roadside ditches due to inadequate outfall. One resident recalled that a culvert at the intersection of Lillian Highway and Bronson Road had apparently been removed by Florida Department of Transportation as part of a shoulder widening project in the late 1990s. Another resident reported that water from the roadside drainage ditch flowed through an open ditch along their property to the east through wetlands towards Bauer Road.

County staff investigated several drainage options to determine the best approach to address the reported and verified drainage issues experienced by the residents along Bronson Road. Multiple easement options were considered. It was determined with designed flow elevations and minor grading and stabilization, this one Drainage Easement could drain runoff from Bronson Road to the west, to a positive outfall, across property owned by Pensacola Christian College, Inc., whose principals agreed to donate.

BUDGETARY IMPACT:
Funds for incidental expenses associated with the recording of documents are available in an Engineering Escrow Account accessed by the Escambia County Clerk's Office.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Drainage Easement was approved as to form and legal sufficiency by Stephen G. West, Senior Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
Upon Board approval, County staff will proceed in compliance with Section 46-139 of the Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will have the Drainage Easement recorded in the public records of Escambia County, Florida.
