RECOMMENDATION:
Recommendation Concerning the Conveyance of a Portion of Real Property Located at 2890 East Olive Road  - Joy Jones, P.E., Engineering Department Director

That the Board take the following action concerning the conveyance of a portion of real property, located at 2890 East Olive Road, at the corner of Olive Road and Caminitti Lane, to Joseph R. Russo:

A. Authorize conveyance of a Quit Claim Deed to Joseph R. Russo to confirm the return of this portion of real property previously conveyed to the County in 2013; and

B. Authorize the Chairman or Vice Chairman to execute the Quit Claim Deed and have it recorded at the County's expense in the Clerk of the Court Public Records.

This property is located in Commission District 4.

BACKGROUND:
Meeting in regular session on November 7, 2013, the Board of County Commissioners approved accepting a portion of right-of-way located at 2890 East Olive Road, via a Warranty Deed, for the Olive Road Improvement Project from Mr. Joseph R. Russo. That Warranty Deed was recorded in Official Records Book 7102 pages 1861-1864 on November 19, 2013. 

During construction of Phase One of the Olive Road Improvement Project, Mr. Russo expressed concerns to staff regarding the location of his new property corners since the 2013 deed had been recorded. Further review of the recorded Warranty Deed and Survey provided by DRMP, a survey discrepancy was found in the location of Mr. Russo’s east property line. 

After research and discussion between Escambia County's surveyor and DRMP’s surveyor, it was determined the best way to correct the error is to record a new right-of-way deed, via this proposed Quit Claim Deed.

The County will retain 675.09 square feet along the eastern side of Mr. Russo's property and the remainder will be conveyed back through the Quit Claim Deed.
BUDGETARY IMPACT:
Funds for incidental expenses associated with recording of documents are available in an Engineering Escrow Account accessed by the Escambia County Clerk's Office.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Quit Claim Deed was approved as to form and legal sufficiency by  Stephen G. West, Senior Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
Upon Board approval, County staff will proceed in compliance with Section 46-139 of the Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will have the Quit Claim Deed recorded in the public records of Escambia County, Florida.
