RECOMMENDATION:
Recommendation Concerning an Interlocal Agreement Between the Escambia County Board of County Commissioners and the Pensacola Downtown Improvement Board - Jack R. Brown, County Administrator

That the Board take the following action concerning the Interlocal Agreement between the Escambia County Board of County Commissioners and the Pensacola Downtown Improvement Board for parking enforcement:

A. Approve the Interlocal Agreement  between the Escambia County Board of County Commissioners and the Pensacola Downtown Improvement Board for parking enforcement in the Ernie Lee Magaha Building garage; special event parking in the M. C. Blanchard Judicial Building and the Ernie Lee Magaha Building garages; and renting reserved parking spaces in the Ernie Lee Magaha Building garage (up to 116 spaces); and

B. Authorize the Chairman to sign the Interlocal Agreement and any subsequent Agreement-related documents, including time extensions.

[Revenue collected from the reserved parking spaces along with the Special Event parking will go into Fund 001-General Fund, Cost Center 310203, Maintenance; Fund 001-General Fund, Cost Center 310207, Utilities; to help off-set the cost of repairs and maintenance of the garages]
BACKGROUND:
On February 21, 2008, the Board approved an Interlocal Agreement between Escambia County and the Pensacola Downtown Improvement Board (DIB) for the Creation of a Comprehensive Downtown Parking Strategy for the Centralized and Efficient Management of Downtown Parking Facilities.  This agreement provided for the management of the County's two Parking Structures; Intendencia Street Parking Garage (Ernie Lee Magaha Government Building) and the Baylen Street Parking Garage (M.C. Blanchard Judicial Building).  This agreement authorized the DIB to lease 116 parking spaces on the top level of the Intendencia Street Parking Garage and manage all after-hours and weekend parking for special events in both parking structures.  The DIB's management of these two parking structures began on April 1, 2008. On April 3, 2014, the Board approved an Interlocal Agreement between Escambia County Board of County Commissioners and the Pensacola Downtown Improvement Board for parking enforcement of the Intendencia Street Parking Garage (Ernie Lee Magaha Government Building)from 7:00 a.m., until 5:30 p.m., Monday through Friday, except on designated holidays. For after-hours special event parking occurring from 5:30 p.m., until 6:00 a.m., Monday through Friday and on weekends.  Under this agreement, DIB terminated its lease rights for the exclusive use of the 116 designated parking spaces due to lack of interest from employees working in neighboring downtown businesses.
BUDGETARY IMPACT:
Revenue collected from the reserved parking spaces along with the Special Event parking will go into Fund 001-General Fund, Cost Center 310203 Maintenance; Fund 001-General Fund, Cost Center 310207, Utilities; to help off-set the cost of repairs and maintenance of the garages.
LEGAL CONSIDERATIONS/SIGN-OFF:
This Interlocal Agreement has been reviewed and approved as to form and legal sufficiency by the County Attorney's Office and the Downtown Improvement Board's Attorney.

POLICY/REQUIREMENT FOR BOARD ACTION:
Board policy requires approval of Interlocal Agreements.
IMPLEMENTATION/COORDINATION:
The County Administrator's Office will work with the Downtown Improvement Board to implement this Agreement.
