RECOMMENDATION:

A Recommendation Concerning the Review of an Interlocal Agreement between Escambia County and the City of Pensacola for Airport Hazard and Incompatible Land Use Zoning

That the Board review and authorize the Chairman to sign the Interlocal Agreement for Airport Hazard and Incompatible Land Use Zoning, pursuant to Chapter 333, Florida Statutes.

BACKGROUND:

Pursuant to the provisions of §163.01 and §333.03(1)(b)(1), Florida Statutes, the County and the City of Pensacola are required to enter into an interlocal agreement. The County and the City have determined that the best compliance is through entering into this Interlocal Agreement (hereafter, the "Agreement"). It is the intent of the language and regulations within the Agreement to ensure the continued safe and efficient use of navigable airspace and operation of airports, airfields and other air navigation or communication facilities within the county.

BUDGETARY IMPACT:

No budgetary impact is anticipated.

LEGAL CONSIDERATIONS/SIGN-OFF:

The attached Interlocal Agreement has been reviewed and approved for legal sufficiency by Meredith D. Crawford, Assistant County Attorney. Any recommended legal comments are attached herein.
