RECOMMENDATION:
Recommendation Concerning a Software License and Service Agreement with the South Central Planning and Development Commission - Shawn P. Fletcher, Information Technology Department Director

That the Board take the following action concerning a Software License and Service Agreement with the South Central Planning and Development Commission :

A. Approve a Software License and Service Agreement with the South Central Planning and Development Commission (SCPDC) for use of the MyGovernmentOnline (MGO) Software Suite at an annual cost of $84,399.84 and with no initial setup fee.  The cost will be divided between Building Inspections Permitting and the Information Technology Department.  This software will replace the current Accela Civic Platform Software that is being used by Building Inspections Permitting, Development Services, and Environmental Code Enforcement;

B. Authorize the issuance of a Purchase Order, in the amount of $84,399.84, to South Central Planning and Development Commission for the MyGovermentOnline Software Suite; and

C. Authorize the County Administrator to execute all documents related to the acceptance of the Software License and Service Agreement with SCPDC for the MGO Software Suite.

BACKGROUND:
Building Inspections Permitting, Development Services, and Code Enforcement have utilized Accela for the daily business activities since 2007. It has become a business tool that does not suit their needs. An alternative has been found in My Government Online, which is developed and maintained by the South Central Planning and Development Commission (SCPDC). The South Central Planning and Development Commission (SCPDC) is a government organization, which only requires a signed agreement to setup a partnership.
The Board approved moving forward with this agreement at the Committee of the Whole on May 11, 2017.
BUDGETARY IMPACT:
In December 2016 Purchase Order # 170899 for $252,587.43 for the renewal of the  Accela Civic Platform Software was issued. By purchasing the South Central Planning and Development Commission MyGovernmentOnline Software Suite will be an approximate annual savings of $170,000. There are no upfront charges other than paying for travel and per diem for South Central Planning and Development (SCPDC) trainers, which GSA pricing has been agreed upon.
LEGAL CONSIDERATIONS/SIGN-OFF:
Assistant County Attorney, Kristin D. Hual, reviewed and approved the Agreement; however, the County Attorney’s Office has requested that the Board be advised that the Agreement does not include the following standard “Governing Law“ provision:
 
Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, and the parties stipulate that venue shall be in the County of Escambia.
PERSONNEL:
No additional personnel are anticipated.
POLICY/REQUIREMENT FOR BOARD ACTION:
This recommendation is in compliance with the provision of the Code of Ordinances of Escambia County, Florida Chapter 46 Article ll, Division 3, Section 81, Purchasing and Contracts
IMPLEMENTATION/COORDINATION:
The Information Technology Department will coordinate efforts on behalf of the County.
