RECOMMENDATION:
Recommendation Concerning the Conveyance of an Access and Utility Easement to Emerald Coast Utilities Authority for Creekwood Subdivision - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action concerning the conveyance of an Access and Utility Easement to Emerald Coast Utilities Authority (ECUA) for Creekwood Subdivision:

A. Adopt the Resolution authorizing the conveyance of an Access and Utility Easement to ECUA for Creekwood Subdivision;

B. Approve the Access and Utility Easement authorizing the conveyance of the Easement to ECUA; and

C. Authorize the Chairman or Vice Chairman to execute the Access and Utility Easement, Resolution, and any other documents necessary to complete the conveyance without any further action from the Board. 

All costs associated with accepting and recording of the documents will be borne by ECUA.
BACKGROUND:
Creekwood Subdivision, Phase I, has a lift station on Parcel "N", which was originally owned by the Creekwood Homeowners Association, but has recently been conveyed to ECUA for ownership. Parcel "N" is surrounded on three sides by Parcel "L" which is owned by the County. ECUA has requested a perpetual Access and Utility Easement over and across Parcel "L" for the purpose of access to Parcel "N", including installation of a paved driveway and utility lines, as well as continued maintenance of the driveway, utility lines and lift station.
BUDGETARY IMPACT:
All costs associated with accepting and recording of documents will be borne by ECUA.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Access and Utility Easement and Resolution were prepared by Stephen West, Senior Assistant County Attorney.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139, Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, Staff will maintain compliance with Section 46-139 of the Escambia County Code of Ordinances.
