Recommendation Concerning Release of all Claims for Property Damage at 4610 Citadel Drive - Robert Dye, Manager, Risk Management Office

That the Board approve and authorize the County Administrator to sign the Release of all Claims for Property Damage at 4610 Citadel Drive.

BACKGROUND:

The County was advised by the resident of 4610 Citadel Drive that his driveway was sinking. On investigation, it was determined that a Cox Cable Vision TV cable had been installed utilizing a County installed French drain as a conduit. The opening in the drain where the cable entered caused significant undermining, and the drain was clogged with sand and required replacement. A demand letter was forwarded to Cox Cable and, through their claims manager at Broadspire, they responded to replace the drain at their expense. During the repair, the roadway was damaged. The claims management company contracted with a paving company to mill and resurface the roadway to County specifications. The County Road Department personnel verified that the job was completed to their specifications. The resident's private property claim was handled as a separate adjustment between the homeowner and the insurer.

Upon completion of the resurfacing, a request for release of all property claims was forwarded to Risk Management by the assigned adjuster responsible for coordinating the repair. He stated that Broadspire will not pay him for the adjustment unless the release is executed.

LEGAL CONSIDERATIONS/SIGN-OFF:

The release was reviewed by the County Attorney who recommends having the County Administrator sign, with Board approval.

IMPLEMENTATION/COORDINATION:

Once signed, Risk Management will return the release to Broadspire, the claims management company for Cox Cable.
