| RECOMMENDATION: |
5:46 p.m. - A Public Hearing Concerning the Review of an Ordinance Amending the 2030 Comprehensive Plan Chapter 3, Definitions, and Chapter 8, Mobility Element
That the Board of County Commissioners (BCC) review and transmit to the Department of Economic Opportunity (DEO), an Ordinance amending the Comprehensive Plan 2030, as amended, Chapter 3, Definitions, and Chapter 8, Mobility Element, CPA-2017-01, to include definitions and to establish a permitting process for airport obstruction notification zones.
At the May 2, 2017, Planning Board Meeting, the Board recommended approval for transmittal to DEO.
This hearing serves as the first of two required public hearings before the BCC. |
| BACKGROUND: |
Florida Statues 333.03, Requirement to adopt airport zoning regulations.If an airport is owned or controlled by a political subdivision and if any other political subdivision has land upon which an obstruction may be constructed or altered which underlies any surface of the airport as provided in 14 C.F.R. part 77, sub-part C, the political subdivisions shall either by interlocal agreement, adopt, administer, and enforce a set of airport protection zoning regulations; or create a joint airport protection zoning board.
Florida Statutes 333.03(2)-Political subdivisions shall adopt, administer, and enforce airport land use compatibility zoning regulations, which at minimum address:
- Landfills
- Prohibition of incompatible uses where airport authority has conducted a noise study in accordance with 14 C.F.R. part 150, or established noise contours pursuant to another public study approved by the Federal Aviation Administration (FAA).
- Prohibition of residential construction and any educational facility where airport authority has not conducted a noise study
- Development of criteria for incompatible uses within runway protection zones

| The attached Ordinance has been reviewed and approved for legal sufficiency by Meredith D. Crawford, Assistant County Attorney. Any recommended legal comments are attached herein. |

| No additional personnel are required for implementation of this Ordinance. |
| POLICY/REQUIREMENT FOR BOARD ACTION: |
| The proposed Ordinance is consistent with the Board’s goal “to increase citizen involvement in, access to, and approval of, County government activities.” |
| IMPLEMENTATION/COORDINATION: |
This Ordinance, amending the LDC, will be filed with the Department of State following adoption by the board.
Implementation of this Ordinance will consist of an amendment to the LDC and distribution of a copy of the adopted Ordinance to interested citizens and staff.
The proposed Ordinance was prepared by the Development Services Department, in cooperation with the County Attorney’s Office and all interested citizens. The Development Services Department will ensure proper advertisement. |
