RECOMMENDATION:
Recommendation Concerning the Scheduling of a Public Hearing to Consider the Vacation of a Portion of Unopened Right-of-Way Off Arthur Brown Road, on the Board's Own Motion - Joy D. Blackmon, P.E., Public Works Department Director 

That the Board schedule a Public Hearing for May 25, 2017, at 5:32 p.m., to consider the vacation of a portion of unopened right-of-way located off of Arthur Brown Road (approximately 0.16 acres) on the Board's own motion:

A. Schedule a Public Hearing for May 25, 2017, at 5:32 p.m., to consider the vacation of a portion of unopened right-of-way located off of Arthur Brown Road (approximately 0.16 acres); and

B. Authorize the expenditure of funds for all costs associated with this vacation.

BACKGROUND:
Arthur Brown Road, located in the Walnut Hill Community, extends west off State Highway 97. Staff is requesting that the County vacate any interest the County has in a portion of unopened right-of-way located off the north side of Arthur Brown Road, just west of Kansas Road. The area to be vacated is shown as Alabama Avenue, per recorded plat of the Walnut Hill Subdivision, dated 1916, recorded 1968. There are only two property owners abutting the area to be vacated, each having access to their property from Arthur Brown Road. Both of these property owners have been contacted and neither has any objection to the requested vacation.  

There are no encroachment issues involved with this vacation request. Staff has reviewed the request and has no objection to the vacation. All utility companies concerned have been contacted and have no objection to the vacation. No one will be denied access to his or her property as a result of this vacation.

Staff is requesting that notifications to surrounding property owners be contained within a 500' radius.
BUDGETARY IMPACT:
Funds for legal advertisements and document recordings are available in Fund 175 “Transportation Trust Fund,” Account 211602/54901.
LEGAL CONSIDERATIONS/SIGN-OFF:
N/A
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
This recommendation is based on the Board’s Vacating, Abandoning, and Closing Existing Public Streets, Rights-of-Way, Alleyways, Roads, Highways, Other Places Used for Travel or Other Lands Dedicated for Public Use or Purposes, or Any Portions Thereof to Renounce and Disclaim Any Right of the County and The Public In and To Said Lands policy for closing, vacating and abandoning County owned property – Section III and Florida Statutes, Chapter 336.
IMPLEMENTATION/COORDINATION:
Once the Public Hearing has been scheduled, the date and time will be advertised, and all owners of property within 500 feet will be notified. It will be the responsibility of County staff to place the advertisement and notify property owners.
