RECOMMENDATION:
January 24, 2017, e-mail communication from Mark Taylor requesting relief of an Environmental Code Enforcement Lien against property located at 12361 Ailanthus Drive.

Recommendation:  That the Board review and consider lien relief request made by Mark Taylor against property located at 12361 Ailanthus Drive.

On August 21, 2014, the Board amended the "Guidelines for Relief from Environmental (Code) Enforcement Special Magistrate Liens" Policy. Section III, H2. Staff was instructed to review all requests for forgiveness of Environmental (Code) Enforcement Liens to determine if the request met the criteria for forgiveness and allowing the County Administrator to act on the Board's behalf if set criteria are met.

After reviewing the request for forgiveness of Liens, staff made the determination that the request does fall within the criteria that would allow the County Administrator to act on the Board's behalf to grant or deny relief, in accordance with the Board's Policy, "Guidelines for Relief from Environmental (Code) Enforcement Special Magistrate Liens" Policy, Section III, H2.

County Administrator Jack Brown sent a denial letter to Mark Taylor on January 19, 2017.
BACKGROUND:
Mark Taylor is the owner of 12361 Ailanthus Drive which has a Code Enforcement lien attached to it in the amount of $23,895.00. Escambia County abated the violations per the Special Magistrate order issued and recorded.

A Certification of Cost letter was mailed to Mr. Taylor in February 2016 at which time he requested to appear before the Special Magistrate to appeal the daily fine amount. A hearing date was set for May 17, 2016. Special Magistrate John B. Trawick reduced the daily fines from $54,810.00 to $18,270.00. This reduced the total lien amount from $60,435.00 to $23,895.00.

January 23, 2017 Our office received another letter from Mr. Taylor  requesting the remaining fines be removed. Per Board Policy a denial letter was mailed to Mr. Taylor from County Administrator Jack Brown.

On January 24, 2017 Mr. Taylor requested to appear before the Board to request further relief. His request has been modified from relief of the daily fines to request that this lien be released from all other properties owned by him and kept on the property located at 12361 Ailanthus Drive only. His intention is to set up a payment plan to pay the lien off in full. Mr. Taylor is a local realtor and this lien is having a negative impact on his business,
BUDGETARY IMPACT:
Court Cost:             $1,100.00
Fines:                  $18,270.00
Abatement Cost:    $4,525.00

Total: $23,895.00

This amount does not include the Clerk's recording fees or interest.
LEGAL CONSIDERATIONS/SIGN-OFF:
If approved by the Board of County Commissioners, the County Attorney's Office will prepare the release.
