RECOMMENDATION:

Recommendation Concerning Environmental (Code) Enforcement MSBU Relief - 828 Tina Avenue.

Request from Mica Johnson asking relief on the MSBU attached to her 2016 tax bill for clean up conducted on her property located at 828 Tina Avenue.

That the Board review and consider relief request made by Mica Johnson against property located at 828 Tina Avenue in the form of an MSBU.

BACKGROUND:

The Office of Environmental Enforcement received a complaint for trash and debris located at 828 Tina Avenue. Officer investigated the complaint and found a large pile of construction debris located on the vacant lot. Information was received that a neighbor illegally dumped the debris on the vacant lot. The Officer made contact with the alleged violator who in turn denied doing the illegal dumping. Due to the lack of evidence and unable to notice the alleged violator, the officer issued a notice of violation to the property owner.

The owner was noticed under Section 42-164, Escambia County Code of Ordinances. This section gives the county the authority to issue a notice of violation to property owners under Summary Abatement. If the owner fails to abate all violations, the county may act to abate all violations. The County may also elect to impose a non-ad valorem special assessment on the property for the cost of the abatement pursuant to Section 42-165 of the Escambia County Code of Ordinances.

The property was initially cited on 3/27/15 and cleaned by Escambia County on 09/01/15. The total cost for the clean up was $800.00 which was all hard cost. This property was not taken before the Special Magistrate so no court cost or fines are involved.

BUDGETARY IMPACT:

Abatement Cost: $800.00.

LEGAL CONSIDERATIONS/SIGN-OFF:

If approved by the Board, the County Attorney's Office will prepare the release.
