RECOMMENDATION:
5:31 p.m. Public Hearing for consideration of the Petition to Vacate a portion of unopened right-of-way known as Grande Boulevard, as petitioned by George and Nita Omley:

Recommendation:  That the Board take the following action concerning the Petition to Vacate a portion of unopened right-of-way known as Grande Boulevard, as petitioned by George and Nita Omley:

A. Approve or deny the Petition to Vacate a portion of unopened right-of-way known as Grande Boulevard, as petitioned by George and Nita Omley;

B. Accept the Hold/Harmless Agreement;

C. Adopt the Resolution to Vacate; and

D. Authorize the Chairman or Vice Chairman to accept the documents as of the day of delivery of the documents to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to execute them at that time.

This request is located in Commission District 2.
BACKGROUND:
Grande Boulevard is an unopened right-of-way that meanders along Bayou Grande. The unopened portion of Grande Boulevard in this request is located in Block 23 of Beach Haven Subdivision.

The petitioners, George and Nita Omley, own the properties located at 2105 and 2109 Augusta Avenue. Mr. and Mrs. Omley purchased these properties in May 2018. A survey completed prior to the purchase indicated that a particular portion of the property, known as the unopened right-of-way of Grande Boulevard, shows no owner of record. The Escambia County Property Appraiser's Office was contacted in an inquiry about the area in question, at which time the petitioners learned that a previously-approved Petition to Vacate, completed in 1977, did not include this portion of unopened right-of-way in the legal description.  The area included in this request has been fenced and occupied by the previous owner for more than 40 years. Due to this history, the Omleys have now submitted a Petition to Vacate this area to Escambia County.

Staff has reviewed the request, with the only concern being future public access to waterfront property. All utility companies have been contacted and have no objections to approval of the Petition to Vacate this property.

Notifications were sent to the surrounding property owners within a 500' radius of the area mentioned in the Petition to Vacate, per the approval of the Request to Schedule at the January 10, 2019, BCC Meeting.
BUDGETARY IMPACT:

Indirect staff cost associated with the preparation of documents and recommendation.

LEGAL CONSIDERATIONS/SIGN-OFF:

N/A

PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:

This recommendation is based on the Board's Vacating, Abandoning, and Closing Existing Public Streets, Rights-of-Way, Alleyways, Roads, Highways, Other Places Used for Travel or Other Lands Dedicated for Public Use or Purposes, or Any Portions Thereof to Renounce and Disclaim Any right of the County and The Public In and To Said Lands policy for closing, vacating and abandoning County Owned property- Section III, and Florida Statues, Chapter 336.

IMPLEMENTATION/COORDINATION:

Upon Board approval of the Petition to Vacate, the necessary documents will be signed and delivered to the Petitioner, who will have them recorded in the public records and will have notices published.
