Recommendation Concerning the Acceptance of Two Drainage Easements and One Public Road and Right-of-Way Easement for the West Kingsfield Road Drainage Project - Joy D. Blackmon, P.E., Public Works Department Director
That the Board take the following action concerning the acceptance of the donation of two Drainage Easements and one Public Road Right-of-Way Easement for the West Kingsfield Road Drainage Project:
A. Accept the donation of the following two Drainage Easements and one Public Road and Right-of-Way Easement for the West Kingsfield Road Drainage Project:

B. Authorize the payment of documentary stamps because the properties are being donated for governmental use, which is for drainage improvements, and the County benefits from the acceptance of these properties, which enhances the safety and well-being of the citizens of Escambia County;
C. Authorize the payment of incidental expenditures associated with the recording of documents; and
D. Authorize the Chair or Vice Chair to accept the Easement documents as of the day of delivery of the Easements, and for the Chair or Vice Chair to acknowledge the Board's acceptance at that time.

BACKGROUND:
This project consists of roadway drainage improvements along West Kingsfield Road from 2025 West Kingsfield Road extending 200' south. To help facilitate the construction and to eliminate stormwater from collecting in the roadway, Mr. and Mrs. Westmark, and Devine Farms, LLC, have agreed to donate the needed easements. These easements will allow for the installation of a drainage swale, which will direct the stormwater to the west.
BUDGETARY IMPACT:
Funds for incidental expenses associated with the recordings of documents are available in an Engineering Escrow Account accessed by Escambia County Clerk's Office.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Drainage Easements and Public Road and Right-of-Way Easement have been signed approved as to form and legal sufficiency by the County Attorney's Office.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139, Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will proceed in compliance with Section 46-139 of the County Code of Ordinances.
