RECOMMENDATION: |
Recommendation Concerning the Scheduling of a Public Hearing to Consider the Petition to Vacate a Portion of Unimproved Right-of-Way Known as Grotto Avenue - Joy D. Blackmon, P.E., Public Works Department Director
That the Board take the following action regarding a Petition to Vacate a Portion of Unimproved Right-of-Way known as Grotto Avenue:
A. Authorize the scheduling of a Public Hearing for April 5, 2018, at 5:32 p.m., to consider the Petition to Vacate a Portion of Unimproved Right-of-Way known as Grotto Avenue (approximately 50 feet x 130 feet, containing 0.14 acres, more or less), as petitioned by George D. Powers; and
B. Require the petitioner to notify all property owners within a 500-foot radius. |
BACKGROUND: |
Grotto Avenue (formerly Oak Avenue) intersects Innerarity Point Road and is located in the Oak Court Addition Subdivision, as recorded in Plat Book 1, Page 8. Grotto Avenue, south of Innerarity Point Road, is not maintained by Escambia County.
The petitioner, Mr. George Powers, is requesting the County to vacate a portion of unimproved right-of-way known as Grotto Avenue, an area approximately 50' x 130', located west of the property that Mr. Powers currently owns.
No one will be denied access to his or her property as a result of this vacation.
There is a parcel of land located south of the vacation area which is currently owned by the property owner on the west side of the area requesting to be vacated. There is currently no direct water access. |

Indirect staff cost associated with the preparation of documents and recommendation.

POLICY/REQUIREMENT FOR BOARD ACTION: |
Based on the Board’s Vacating, Abandoning, and Closing Existing Public Streets, Rights-of-Way, Alleyways, Roads, Highways, Other Places Used for Travel or Other Lands Dedicated for Public Use or Purposes, or Any Portions Thereof to Renounce and Disclaim Any Right of the County and The Public In and To Said Lands policy for closing, vacating and abandoning County owned property – Section III and Florida Statutes, Chapter 336.

IMPLEMENTATION/COORDINATION: |
Once the Public Hearing has been scheduled, the Petitioner will be notified, the date and time will be advertised, and all owners of property within the area determined by the Board will be notified.
