Recommendation Concerning Authorization for the Acquisition of Real Property for Stormwater Drainage in the Crescent Lake Area - Joy D. Blackmon, P.E., Public Works Department Director

That the Board take the following action: 

A. Approve, by super majority vote, or deny, the purchase of the following parcel of real property for stormwater drainage in the Crescent Lakes area, for the submitted counteroffer:

B. Authorize staff to draft a Contract for Sale and Purchase for the property for a specified amount and bring the executed Contract back before the Board.

BACKGROUND:
During the April 2014 storm event, the area of Blue Springs Avenue, within the Crescent Lake subdivision, suffered significant damage to public infrastructure and private properties. Escambia County responded with the Crescent Lake Dam Project (funded by National Resources Conservation Services), the Blue Springs Avenue FEMA Repair Project, and the East Shore Drive FEMA Outfall Pipe Replacements to Crescent Lake Project.

Given the extent of damage, the Blue Springs Avenue at Clearwater Avenue Drainage Analysis was also completed to identify drainage deficiencies, and to determine the best alternatives to mitigate future re-occurrence of such drainage impacts. Stormwater attenuation improvements in the upstream basin, contributing to Blue Springs Avenue, were determined necessary in the area of Sun Valley Drive, Glass Drive, and Clearwater Avenue. Potential stormwater improvements for Empire Pit were also referred to Florida Department of Transportation for consideration. The recommended alternative is to maximize the pond stormwater volume, depending upon successful property acquisition.

This parcel, while not part of Crescent Lake subdivision, is necessary to provide an area for design/construction of a stormwater management system, to optimize flood reduction, and to improve water quality for Crescent Lake.

There is currently a manufactured home located on the property at 5548 Glass Drive. Before the appraisal was commissioned,  Mr. Jones' was informed that the County has no interest in the manufactured home on the property. Mr. Jones has agreed to have the manufactured home removed prior to purchase of the property, if an agreement is reached. Therefore, the appraisal was completed as if the land was vacant/unimproved.
BUDGETARY IMPACT:

Funding is available in Fund 352, "LOST III," Cost Center 210107, Object Code 56101, Project #15EN3252.

LEGAL CONSIDERATIONS/SIGN-OFF:
All documents will be reviewed by the County Attorney's Office before purchase is finalized.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139 of the Escambia County code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will maintain compliance with Section 46-139 of the County Codes.
