	A.	7798	COMPLAINT NO.: COM140700021 - Kent Dilts dba Maintenance and Repair, Inc., aka Dilt's Construction, Inc. - State Certified Residential Contractor License No.: CRC1330062 RE: Complaint(s) filed simaltaneously with DBPR and the Contractor Competency Board ("Board") by Tina Martin back in July 2014. On November 5, 2014, this Board voted to retain jurisdiction over the matter until a report was received from DBPR. BID Staff was notified by an email from DBPR Investigator, P. Newman, that DBPR closed the complaint filed by Ms. Martin against Kent Dilts/Dilts Construction as "Insufficient Evidence."

	B.	7799	COMPLAINT NO.: COM141200054 - Charlie M. Hamrick dba H & H Construction, Inc. RE: John Weiss, Complainant/Homeowner, 2546 Corral Drive, Cantonment. The Complainant/Homeowner has requested the complaint be withdrawn as the parties have amicably settled matters between them.

	A.	7801	PUBLIC HEARING: TIMOTHY HUGH COLLINS dba Marketplace Builders, LLC - State Certified Building Contractor License No.: CBC1255192; Complaint No.: COM141200050 RE: Jamison Janes, Complainants/Homeowners, 8207 Foxtail Loop, Pensacola. VIOLATIONS: Count I: “Knowingly combining with or conspiring with an uncertified or an unregistered person by allowing one’s certificate to be used by that person with intent to evade the provisions of this article …” Sec. 18-37(c)(3), Escambia County Code of Ordinances; and F.S. § 489.129(1)(e). Count II: “A certified or registered contractor, or contractor authorized by a local construction regulation board to do contracting, may not apply for or obtain a building permit for construction work unless the certified or registered contractor, or contractor authorized by a local construction regulation board to do contracting, or business organization duly qualified by said contractor, has entered into a contract to make improvements to, or perform the contracting at, the real property specified in the application or permit. …” F.S. § 489.127(4)(c). Count III: “Mismanagement or misconduct causing financial harm to the customer …” Sec. 18-37(d)(8), Escambia County Code of Ordinances; and F.S. § 489.129(1)(j), as amended. Count IV: Diversion of funds or property received for prosecution or completion of a particular construction project or operation by the contractor when as a result of such diversion the contractor is or will be unable to fulfill the terms of his obligations or contract …” Sec. 18-37(c)(5), Escambia County Code of Ordinances. Count V: “Failure to keep business and financial records as required …” Sec. 18-37(d)(9)(a), Escambia County Code of Ordinances. Count VI: “Failure to notify residential property owner of recovery fund …” Sec. 18-37(d)(9)(j); and F.S. § 489.1195, as amended. Count VII: “False payment statement, valid liens were filed or customer otherwise injured …” Sec. 18-37(11)(a), Escambia County Code of Ordinances.
