RECOMMENDATION:
Recommendation Concerning the Florida Department of Environmental Protection Grant Agreement No. DH012, in the Amount of $423,120, for the Carpenter Creek Headwater Water Park Amenities Project - J. Taylor "Chips" Kirschenfeld, Director, Department of Natural Resources Management 

That the Board take the following action concerning the award of Florida Department of Environmental Protection Grant Agreement No. DH012 Carpenter Creek Headwater Park Amenities Project:

A. Approve the award of DEP Grant Agreement No. DH012, in the amount of $423,120.00, for the design, permitting, and construction of the Carpenter Creek Headwater Park Amenities Project; and

B. Authorize the Chairman to sign the Agreement and any future amendments related to no-cost time extensions, subject to Legal review and sign-off, without further action of the Board.
  
NOTE:  The County Attorney's Office has requested the Board be made aware of the following language:


Paragraph 23(d) of Attachment 1 states, "Jurisdiction for any damages arising under the terms of the Agreement will be in the courts of the State, and venue will be in the Second Judicial Circuit, in and for Leon County."

[Funding:  Fund 118, Gulf Coast Restoration Fund, new cost center to be determined at time of SBA approval. No local match required]

This project is located in Commission Districts 3 and 4.

NON-ADA COMPLIANT DOCUMENT TO BE DISTRIBUTED UNDER SEPARATE COVER:
  • State of Florida Department of Environmental Protection Standard Grant Agreement (HD012) for the Carpenter Creek Headwater Park Amenities Project
BACKGROUND:
The Natural Resource Damage Assessment (NRDA) Florida Trustee Implementation Group (TIG) has included the Carpenter Creek Headwater Park Amenities Project within Florida's Final Restoration Plan. The project will provide and enhance recreational opportunities through the construction of a public park at the headwaters of Carpenter Creek. The project is a companion to a NDRA water quality improvement project, both of which are part of the RESTORE Act Direct Component (Pot 1) funded Carpenter Creek and Bayou Texar Watershed Management Plan. The project will enhance public access by providing a new recreational opportunity in an area with no current recreational access. The trail and paddle-craft launch will allow users to access the lake feature of the creek, a result of a series of beaver dams. The new parking area will also enhance public access to the area. The passive recreation area will feature tables and benches to allow users to enjoy the park views while maintaining the native tree canopy. The educational signage will enhance awareness of the restoration efforts and importance of the creek and watershed.
BUDGETARY IMPACT:
Funding:  Fund 118, Gulf Coast Restoration Fund, new cost center to be determined at time of SBA approval. No local match required.
LEGAL CONSIDERATIONS/SIGN-OFF:
Kristin Hual, Senior Assistant County Attorney, has reviewed and provided legal sign-off of DEP Agreement No. DH012.
PERSONNEL:
No additional impact on personnel associated with this Recommendation.
POLICY/REQUIREMENT FOR BOARD ACTION:
Board Policy II.B.8. 
IMPLEMENTATION/COORDINATION:
Department of Natural Resources Management staff will coordinate with DEP staff to implement the project.
