RECOMMENDATION:
October 21, 2019, communication from Beatrice Boykn Benjamin requesting lien relief for the property located at 2200 West Moreno Street.

Recommendation: That the Board review and consider the lien relief request made by Beatrice Boykn Benjamin, owner of the property located at 2200 West Moreno Street.

On August 21, 2014, the Board amended the "Guidelines for Relief from Environmental (Code) Enforcement Special Magistrate Liens" policy, Section III, H2. Staff was instructed to review all requests for forgiveness of Environmental (Code) Enforcement Special Magistrate Liens to determine if the request met the criteria for forgiveness and allowing the County Administrator to act on the Board's behalf if set criteria are met.

After reviewing the request for forgiveness of liens, staff made the determination that the request does not fall within the criteria that would allow the County Administrator to act on the Board's behalf and grant relief, in accordance with the Board's Policy, "Guidelines for Relief from Environmental (Code) Enforcement Special Magistrate Liens" Policy, Section III, H2.

BACKGROUND:
Ms. Beatrice Boykn Benjamin was one of two owners  and violators at the time of the noticing and hearing. Proper notices were issued and owners failed to comply. Code violations were overgrowth, trash, debris and dilapidated house. Special Magistrate hearing was held May 10, 2016. Owners were given until July 9, 2016 to abate all violations or a daily fine in the amount of $10.00 per day will commence July 10, 2016.

Ms. Benjamin became the full owner of the property located at 2200 West Moreno Street on June 1, 2016. She Benjamin was able to obtain demolition assistance through the Escambia/Pensacola Community Development Block Grant Demolition Assistance Program implemented by Neighborhood & Human Services Department Neighborhood Enterprise Division. The Office of Environmental Enforcement worked with this agency to obtain the lowest demolition price and had the structure demolished and property cleaned. A lien was placed on the property for the demolition assistance in the amount of $5,250.

Total Special Magistrate Lien is $1,360. Court cost was $1,100 (which will be reduced to $550 when paid) and fines in the amount of $260.

This amount does not include the Clerk's recording fees or interest
