RECOMMENDATION:
October 23, 2019, communication from Kristopher Fernandez, representative for Bay to Gulf Holdings, LLC, requesting lien relief for property located at 9925 Beulah Road. 

Recommendation: That the Board review and consider the lien relief request made by Kristopher Fernandez against 9925 Beulah Road.

On August 21, 2014, the Board amended the "Guidelines for Relief from Environmental (Code) Enforcement Special Magistrate Liens" policy, Section III, H2. Staff was instructed to review all requests for forgiveness of Environmental (Code) Enforcement Liens to determine if their request met the criteria for forgiveness and allowing the County Administrator to act on the Board's behalf if set criteria are met.

After reviewing the request for forgiveness of liens, staff made the determination that the request did fall within the criteria that would allow the County Administrator to act on the Board's behalf and grant relief, in accordance with the Board's Policy, "Guidelines for Relief from Environmental (Code) Enforcement Special Magistrate Liens" Policy, Section III, H2.

County Administrator Janice Gilley did provide relief to Bay to Gulf Holdings, LLC waiving all but $5,000 of the $62,950 lien amount. Bay to Gulf Holdings LLC, refused that offer and made a request to appear before the Board to request full release.

BACKGROUND:
The property located at 9925 Beulah Road was foreclosed on by Nationstar Mortgage, LLC, on July 5, 2016. On July 24, 2018, Bay to Gulf Holdings, LLC, became the owners of the property. Escambia County was served in the foreclosure action. In August 2019, Bay to Gulf Holdings, LLC, made a request for lien relief. The request was processed and County Administrator Janice Gilley granted relief and offered to release the lien for the amount of $5,000. Bay to Gulf Holdings, LLC, turned down the offer and made a request to appear before the Board. They are requesting a full release of the lien to have a clear title.
BUDGETARY IMPACT:
Court Cost: $500.00
Administration Fines: $62,450.00

Total Lien : $62,950.00

This amount does not include the Clerk's recording fees or interest.

If approved by the Board, the County Attorney Office will prepare the release.
