RECOMMENDATION:

Recommendation Concerning the Lease Agreement between Escambia County and Perdido Key Area Chamber of Commerce, Inc., for County-Owned Property at 15500 Perdido Key Drive, Florida - Robert E. Dye, Interim Director, Facilities Management

That the Board take the following action:

A. Amend the Boards action approving the Lease Agreement on October 3, 2019;

B. Authorize the substitution of the version of the lease executed by the Perdido Key Area Chamber of Commerce, Inc., on September 9, 2019, in place of the earlier version that was inadvertently included with the Resolution and Recommendation from October 3, 2019; and

C. Ratify the Chairman's Signature on Lease Agreement executed by the Perdido Key Area Chamber of Commerce, Inc., on September 9, 2019.

Rent is to be paid to the County in the amount of $1.00 per year.

BACKGROUND:

On October 3, 2019, the Board adopted a Resolution to approve and authorize the Chairman to sign a Lease Agreement between Escambia County and the Perdido Key Area Chamber of Commerce, Inc. (PKACC), for the property located at 15500 Perdido Key Drive, Pensacola, Florida 32507. Although the correct Lease Agreement was signed by the Chairman, the wrong Lease Agreement was attached to the Recommendation. This Recommendation is to correct the Clerical Error.

Lease Agreement with Perdido Key Area Chamber of Commerce, Inc. (PKACC), for a portion of the real property located at 15500 Perdido Key Drive, Pensacola, FL 32507. The initial term of the lease is for five (5) years and allows for the Lease to be renewed for successive terms of five (5) years. Exhibit A clarifies the areas occupied by the Perdido Key Area Chamber of Commerce, Visit Pensacola and Escambia County Natural Resources.

The Perdido Key Area Chamber of Commerce promotes progressive leadership in commerce for a dynamic and prosperous community in the Perdido Area. The Perdido Key Area Chamber of Commerce is dedicated to endorse the Perdido Area’s growth of regional businesses and community prosperity through Advocacy, leadership, economic development, education and associations across state lines.

BUDGETARY IMPACT:

Perdido Key Area Chamber of Commerce, Inc., will pay rent of one dollar ($1.00) per year.

LEGAL CONSIDERATIONS/SIGN-OFF:

The County Attorney's Office has prepared the the Lease Agreement and approved as to form and legal sufficiency.

POLICY/REQUIREMENT FOR BOARD ACTION:

Current Policy requires Board approval for Lease Agreements involving County-owned property.
