RECOMMENDATION:
5:31 p.m. Public Hearing for consideration of the Petition to Vacate an opened right-of-way known as Cameron Lane, as petitioned by VWSS American, LLC.

Recommendation:  That the Board take the following action concerning the Petition to Vacate an opened right-of-way known as Cameron Lane (0.44 acres, more or less), as petitioned by VWSS American, LLC.:
  
A. Approve or deny the Petition to Vacate an opened right-of-way known as Cameron Lane;

B. Accept the Hold/Harmless Agreement;

C. Adopt the Resolution to Vacate; and

D. Authorize the Chairman or Vice Chairman to accept the documents as of the day of delivery of the documents to the Chairman or Vice Chairman, and authorize the Chairman or Vice Chairman to execute them at that time.

The real property mentioned in this Petition to Vacate is located in Commission District 2.
BACKGROUND:
Cameron Lane is located behind South Gate Plaza Shopping Center and connects to South Old Corry Field Road. 

The Petitioner recently purchased the property to the north and to the south of Cameron Lane. The property to the north of Cameron Lane is presently used as a storage facility with self-storage units. The property to the south of Cameron Lane is presently used for outside storage of boats, vehicles, trailers, and motor homes. Prior to the Petitioner purchasing the property, the Petitioner's attorney, Thomas Balmat, had inquired if Cameron Lane was a private road or a county-maintained road. To clear up the title, the Petitioner is going through the Petition to Vacate process.

A Right-of-Way Easement from The United States Postal Service (USPS) to Escambia County, Florida, recorded in Official Records Book 2978, Pages 647-650 was conveyed to the County "for public road or highway purposes, so long as the same shall be used, operated, and maintained as a public road or highway." According to the Road Department, the County does not currently maintain Cameron Lane, and has not since this Easement was recorded in 1991. Staff has no concerns with the Petition to Vacate Cameron Lane. 

Staff did receive correspondence from the local USPS Postmaster, who stated her concerns (see attached email).

Gulf Power and Peoples Water Service Company of Florida, Inc., have existing easements in the area of Cameron Lane which they want to retain.

County GIS staff has reviewed their records and noted that this road is not included in the GIS data and there is no record that the Board has approved the naming of this road. 

Per Board direction, notification was mailed to property owners within a 1500' radius.

From historical aerial photos, the road appears to have been constructed when Moreno Courts was developed in the 1940's.

BUDGETARY IMPACT:

Indirect staff cost associated with the preparation of documents and Recommendation.

LEGAL CONSIDERATIONS/SIGN-OFF:

N/A

PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:

This Recommendation is based on the Board's Vacating, Abandoning, and Closing Existing Public Streets, Rights-of-Way, Alleyways, Roads, Highways, Other Places Used for Travel or Other Lands Dedicated for Public Use or Purposes, or Any Portions Thereof to Renounce and Disclaim Any right of the County and The Public In and To Said Lands policy for closing, vacating and abandoning County Owned property- Section III, and Florida Statues, Chapter 336.

IMPLEMENTATION/COORDINATION:

Upon Board approval of the Petition to Vacate, the necessary documents will be signed and delivered to the Petitioner or the Petitioner's agent, who will have them recorded in the public records and will have notices published.
