RECOMMENDATION:
Recommendation Concerning the Matter of Arbitration Between Escambia County Board of County Commissioners, Employer, and Florida Police Benevolent Association, Inc., Union; FMCS Case No. 190529-07585.

That the Board accept the following information:

On January 29, 2020, Arbitrator Daniel R. Saling issued a Final and Binding Arbitration Award upholding the termination of the grievant, and dismissing the grievance initiated by the Florida Police Benevolent Association (FPBA).
BACKGROUND:
Effective March 29, 2019, the grievant was terminated from his employment as a Correctional Officer with Escambia County Corrections after an internal investigation concluded that on or about January 31, 2019, the grievant negligently performed his assigned duties and falsified department records. The FPBA initiated a grievance on behalf of the grievant, and the matter was referred to arbitration in accordance with the terms of the collective bargaining agreement.

On November 19, 2019, an arbitration proceeding was held with Daniel R. Saling serving as the appointed, impartial arbitrator. The County was represented by Michael Mattimore of Allen, Norton & Blue and Senior Assistant County Attorney, Kristin Hual. The FPBA was represented by Lacey Corona of Nelson, Mullins, Broad & Cassel. After reviewing the testimony and evidence presented at the hearing and considering the parties' post-hearing briefs, Arbitrator Saling issued a Final and Binding Arbitration Award upholding the termination of the grievant and dismissing the grievance initiated by the Florida Police Benevolent Association.

In accordance with the terms of the collective bargaining agreement, the Union, as the non-prevailing party, shall bear all fees and costs incurred to retain the arbitrator.
