RECOMMENDATION:
Recommendation Concerning the Escambia County 2019 Voluntary Cleanup Tax Credit Application to the Florida Department of Environmental Protection - Clara Long, Interim Neighborhood & Human Services Department Director

That the Board take the following action concerning the 2019 Voluntary Cleanup Tax Credit Application to the Florida Department of Environmental Protection:

A. Rescind the previous action of January 23, 2020, approving and authorizing the Chairman or Vice Chairman to sign the 2019 Florida Department of Environmental Protection (FDEP) Voluntary Cleanup Tax Credit (VCTC) Application and Affidavit, for County-owned property at 603 West Romana Street; and

B. Approve the revised 2019 FDEP Voluntary Cleanup Tax Credit (VCTC) Application and Affidavit, for County-owned property at 603 West Romana Street and ratify the Chairman's signature.
BACKGROUND:
The County is eligible to apply for tax credits through the Florida Department of Environmental Protection (FDEP) Voluntary Cleanup Tax Credit (VCTC) Program. The Program allows entities and/or individuals to recover certain expenses incurred in the voluntary execution of site assessment/remediation for hazardous materials in the form of tax credits issued by the Florida Department of Revenue through the FDEP.

On January 23, 2020, the Board approved and executed the 2019 VCTC Application for completed remediation work. After futher review, staff learned there were additional documents not included in the original submital to the Board Meeting. The following documents were omitted and a minor change (strikethrough) was made to originals:  1) The Warren Averett Independent Accountants' Report that includes Attachment A, Schedule of Costs was omitted, and 2) Section IV Tax Credit Claim and Calculation, subsection C Site Rehabilitation Completion Order needed a minor change of strikethrough.
BUDGETARY IMPACT:

In the event of monetary gain, funds from the tax credits will be deposited in Fund 129, CDBG HUD Entitlement, VCTC/Brownfields.

LEGAL CONSIDERATIONS/SIGN-OFF:

Kristian D. Hual, Senior Assistant County Attorney, has reviewed and approved the application as to form and legal sufficiency.

PERSONNEL:

Neighborhood & Human Services/Community Redevelopment Agency (NHS/CRA) staff will coordinate all tasks.

POLICY/REQUIREMENT FOR BOARD ACTION:
Board approval is required for submittal of this Application.
IMPLEMENTATION/COORDINATION:
NHS/CRA staff, in coordination with the FDEP, shall execute and deliver all documents and perform further actions necessary.
