| RECOMMENDATION: |
Recommendation Concerning Exercising the Second of Two Possible One-Year Renewal Periods Related to Gasoline and Diesel Fuel Delivery - Wes Moreno, Department Director, Public Works, through Paul Nobles, Purchasing Manager, Office of Purchasing
That the Board approve the utilization of the second of two possible one-year renewal periods provided for under Section 2 of the Agreement for Gasoline and Diesel Fuel Delivery, retroactive to October 1, 2019.

| BACKGROUND: |
| Invitation to Bid, PD 16-17.087, Gasoline and Diesel Fuel Delivery, was publicly noticed on September 11, 2017. The County entered into an Agreement with Cougar Oil, Inc., on April 5, 2018. Section 2 of the Agreement outlines the Term of the Agreement, which states that the first period of the Agreement will end September 30, 2018, and provides for up to two optional one-year renewal periods. The first renewal period was covered from October 1, 2018 to September 30, 2019. This second renewal period will cover from October 1, 2019 to September 30, 2020. |

| LEGAL CONSIDERATIONS/SIGN-OFF: |
| Kristin Hual, Senior Assistant County Attorney, reviewed the initial Agreement. The utilization of the renewal period as provided for in Section 2 of the Agreement does not require an Amendment to the Agreement. |

| POLICY/REQUIREMENT FOR BOARD ACTION: |
| The Escambia County Board of County Commissioners has indicated that they wish to review those Agreements in which the County indicates the desire to exercise a renewal period beyond the initial term of the Agreement. |
| IMPLEMENTATION/COORDINATION: |
| Upon approval by the Board, the Office of Purchasing will communicate with the impacted department(s) as well as the firm, Cougar Oil, Inc., regarding the renewal. |
