RECOMMENDATION:
Recommendation Concerning an Agreement for SUNPASS and TOLL-BY-PLATE Electronic Toll Collection at the Bob Sikes Bridge Toll Plaza Between Escambia County, Florida and the Florida Department of Transportation - Joy Jones, P.E. - Engineering Department Director

That the Board take the following action regarding the Agreement for SUNPASS and TOLL-BY-PLATE Electronic Toll Collection at the Bob Sikes Bridge Toll Plaza:

A.  Approve the Agreement for SUNPASS and TOLL-BY-PLATE Electronic Toll Collection at the Bob Sikes Bridge Toll Plaza between Escambia County and the Florida Department of Transportation; and
 
B.  Authorize the Chairman to sign the Agreement.

The Bob Sikes Toll Plaza is located in Commission District 4

[Funding: There is no additional funding anticipated for this Agreement; however, costs for the signage and pavement marking upgrades required at the Bob Sikes Toll Plaza for the All Electronic Tolling conversion are anticipated to be approximately $30-40K, which will be funded out of the Bob Sikes Toll Fund]
BACKGROUND:
At its December 5, 2019, regular meeting, the Board directed staff to proceed with the conversion of the Bob Sikes Toll Plaza from its current configuration of Electronic Tolling Collection (ETC) to All Electronic Tolling (AET), and further approved a Purchase Order to DRMP, Inc., to perform design services for the respective signage and pavement markings needed for such conversion.

The Board, at its December 10, 2015, regular meeting, approved an Agreement with the Florida Department of Transportation (FDOT) - Florida's Turnpike Enterprise (FTE) to process electronic tolling transactions generated by Escambia County at the Bob Sikes Toll Plaza.

This AET Agreement replaces the ETC Agreement; however, the primary change in the process is the removal of cash transactions. The toll fee will remain at $1.00, and the cost per transaction to process via FTE will remain at $0.08. The electronic toll collection process will remain the same, as Escambia County will transmit all electronic toll transactions (excluding Pensacola Beach Annual Pass and other exempt transactions) on to FTE for appropriate processing.

County and FTE staff anticipate to "go live" with the AET system in April 2020, with the necessary signage and pavement marking changes to occur between March and April 3, 2020. 

Note: Section 16 "Governing Law and Venue" of the attached Agreement states "The laws of the State of Florida shall solely govern the validity of this Agreement and any of its terms and provisions, as well as the rights and duties of the Parties of this Agreement. The venue for any action in connection with this Agreement shall be any court of competent jurisdiction in Leon County, Florida."
BUDGETARY IMPACT:
There is no additional funding anticipated for this Agreement; however, costs for the signage and pavement marking upgrades required at the Bob Sikes Toll Plaza for the All Electronic Tolling conversion are anticipated to be approximately $30-40K, which will be funded out of the Bob Sikes Toll Fund.
LEGAL CONSIDERATIONS/SIGN-OFF:
The Agreement was reviewed and approved for Legal Sufficiency by Kristin Hual, Senior Assistant County Attorney.

Legal has asked we note that Section 16 "Governing Law and Venue" of the attached Agreement states "The laws of the State of Florida shall solely govern the validity of this Agreement and any of its terms and provisions, as well as the rights and duties of the Parties of this Agreement. The venue for any action in connection with this Agreement shall be any court of competent jurisdiction in Leon County, Florida."
PERSONNEL:
No additional personnel anticipated.
POLICY/REQUIREMENT FOR BOARD ACTION:
Board policy requires Board approval of all Agreements.
IMPLEMENTATION/COORDINATION:
Upon approval of the Agreement, staff will transmit the signed copy to FTE for formal execution.
