RECOMMENDATION:
Recommendation Concerning the Scheduling of a Public Hearing to Consider the Vacation of a Portion of an Unopened Right-of-Way Known as Juan Road - Joy Jones, P.E. Engineering Department Director

That the Board schedule a Public Hearing for March 5, 2020, at 5:32 p.m., to consider the Petition to Vacate a Portion of an Unopened Right-of-Way known as Juan Road, as petitioned by Breland Homes Coastal, LLC, represented by their Agent, Joe Rector:

A. Authorize the scheduling of a Public Hearing for March 5, 2020, at 5:32 p.m., to consider the Petition to Vacate a Portion of an Unopened Right-of-Way Known as Juan Road (0.49 acres, more or less), as petitioned by Breland Homes Coastal, LLC, represented by their Agent, Joe Rector; and

B. Require the Petitioner to notify all property owners within a 1,500 foot radius.

The real property mentioned in this Petition to Vacate is located in Commission District 1.
BACKGROUND:
The Petitioner recently purchased several parcels of real property, totaling 21 acres, lying between Bronson Road and Bauer Road. This portion of unopened right-of-way, known as Juan Road, lies in the middle of two of those parcels.

The Petitioner has met with the Developmental Review Committee and has submitted plans for a 50-lot residential development on the property, with access from Bronson Road. Vacating Juan Road would make the property one continuous property, allowing for the development to move forward.

Staff has no concerns with the Petition to Vacate. The utility companies have no concerns or objections to the vacation request.
BUDGETARY IMPACT:

Indirect staff cost associated with the preparation of documents and Recommendation.

LEGAL CONSIDERATIONS/SIGN-OFF:
