RECOMMENDATION:
5:45 p.m. - A Public Hearing Concerning the Renewal of a Recycling Permit for an Asphalt/Concrete Crushing Recycling and Processing Facility located at 5570 Bellview Avenue, Pensacola, FL, McDirt Concrete Recycling Facility

That the Board of County Commissioners (BCC) review and approve, modify, or deny the renewal of a Recycling Permit for an existing asphalt/concrete crushing recycling and processing facility located at 5570 Bellview Avenue, Pensacola, FL, owned by McDirt Industries, Inc.
BACKGROUND:
On August 2, 2018, the Escambia County Board of Commissioners (BCC) authorized the renewal of a recycling permit for an Asphalt/Concrete Crushing Recycling and Processing Facility, originally approved/issued on February 9, 2017, for McDirt Concrete & Asphalt Recycling Facility (PSP #160400052), located at 5570 Bellview Avenue, Pensacola, FL. This permit and a copy of the Development Order are attached hereto as Attachment A.

Pursuant to the conditions of the approved Permit #PSP160400052 and the Escambia County Code of Ordinances governing renewal of such permit, the County received an application from McDirt Industries, Inc. requesting a Renewal Permit, prior to the expiration of the current permit. The current permit was extended, as allowed, for 180 days for McDirt Industries, Inc.; so that, staff could begin the renewal permitting process as requested by the applicant as applicable with County’s Regulations. See Attachment B.

Pursuant to the terms of the approved permit, the executed permit extension is set to terminate on the date that a renewal permit is approved, modified, or denied by the Escambia County Board of County Commissioners, however the extension shall not be more than 180 days. The current extension, and thus the operational permit, is scheduled to expire on February 8, 2020.

The request renewal permit is attached, see Attachment C.
BUDGETARY IMPACT:
No budgetary impact is anticipated if the renewal permit is approved.
LEGAL CONSIDERATIONS/SIGN-OFF:

This recommendation is consistent with the previous practices of the County Attorney’s Office.

PERSONNEL:
No additional personnel are required for the implementation of this permit renewal.
POLICY/REQUIREMENT FOR BOARD ACTION:
Per the Board of County Commissioners policy and directive, the renewal of a recycling permit for an asphalt/concrete crushing recycling and processing facility requires Board of County Commissioner approval.
IMPLEMENTATION/COORDINATION:

If the Board approves the renewal of the recycling permit for McDirt Industries, Inc., the Development Services Department will implement the process for issuance of the renewal permit.
