RECOMMENDATION:
Recommendation Concerning Authorization for the Acquisition of Real Property Located in the 7600 Block of Winodee Drive for Carpenter Creek Riparian Preservation - Joy Jones, P.E., Engineering Department Director

That the Board take the following action regarding the acquisition of real property located in the 7600 Block of Winodee Drive, owned by Gulf Timberlands, Inc.:

A. Authorize the purchase of real property located in the 7600 block of Winodee Drive (approximately 5.23 acres), for $108,208.70, which is the Board's approved purchase price for the Carpenter's Creek Riparian Preservation project;

B. Approve or deny the Contract for Sale and Purchase for the acquisition of real property located in the 7600 block of Winodee Drive (approximately 5.23 acres) from Gulf Timberlands, Inc., for $108,208.70, for the Carpenter Creek Riparian Preservation project; 

C. Accept, for information, the Public Disclosure of Interest Form provided by Gulf Timberlands, Inc.;

D. Authorize the County Administrator to execute an IRS Form 8283, subject to Legal sign-off; and

E. Authorize the County Attorney's Office to prepare, and the Chairman or Vice Chairman to execute any documents, subject to Legal review and sign-off, necessary to complete the acquisition of these properties, without further action of the Board.

The real property is located in Commission District 4.

BACKGROUND:
The development of a revitalization plan for Carpenter Creek and Bayou Texar is identified as a project in the 2017 RESTORE Act Multi-Year Implementation Plan (MYIP) for Escambia County Direct Component expenditures (Pot 1). The Board has already acquired a 7-acre parcel along Olive Road near the headwaters of Carpenter Creek for conservation, environmental restoration, and public recreation.  

Staff was given verbal direction by the Board on April 16, 2019, to evaluate another property for potential acquisition. This second 5.23-acre property is also located in the vicinity of the Carpenter Creek headwaters. The address of the property is listed as the 7600 block of Winodee Drive (19-1S-30-1401-000-000). The appraisal, which considered the existing wetlands, values the parcel at $72,700. Meeting in regular session on December 5, 2019, the Board approved the counter-offer of $108,208.70.   

Approximately 50% of the property appears to be wetlands associated with Carpenter Creek. Potential public uses of the property include conservation, environmental restoration, and public recreation. County acquisition would support revitalization efforts for Carpenter Creek and Bayou Texar.

The owner provided a counteroffer (attached) of $108,208.70. This value was determined by utilizing the sales price per acre for Comp #1 ($42,614) and Comp #2 ($40,146) in the County-obtained appraisal and applying it to half of the acreage (2.615 acres). The average of the two comps is $41,380. The property owner discredited Comp #3 due to the wetlands on that parcel splitting the property and that parcel having access issues. The Adjustment Grid for Comparable Land Sales, which shows both the sales price per acre and the adjusted price per acre, is on page 31 of the full appraisal for this property (attached).
 
Regarding the remaining half of the subject property, which appears to be wetlands, the owner is applying a value of $14,000 per acre, totaling $36,610, and is asking for tax donation credits. The property owner was advised to discuss this with his accountant, to which they submited an IRS Form 8283.
BUDGETARY IMPACT:

Funding is available in Fund 352, LOST III, Cost Center 220102, NESD Capital Projects, Project 08NE0028, Environmentally Sensitive Lands.

LEGAL CONSIDERATIONS/SIGN-OFF:
The Contract for Sale and Purchase was approved by Stephen G. West, Senior Assistant County Attorney. The County Attorney's Office will prepare the closing documents and conduct the closing for the purchase of this property.
PERSONNEL:
All work associated with this request is being done in-house and no additional staff is required.
POLICY/REQUIREMENT FOR BOARD ACTION:
These actions are consistent with the provisions of Section 46-139 of the Escambia County Code of Ordinances.
IMPLEMENTATION/COORDINATION:
Upon Board approval, staff will maintain compliance with Section 46-139 of the County Codes.
