RECOMMENDATION:
Recommendation Concerning the State of Florida, Division of Emergency Management, Federally-Funded Subgrant Agreement - Flood Mitigation Assistance Grant Modification Number 3 - Tim Tolbert, Building Official, Department Director

That the Board take the following action concerning the State of Florida, Division of Emergency Management, Federally-Funded Subgrant Agreement - Flood Mitigation Assistance Grant Modification Number 3:

A. Approve Modification Number 3 to Subgrant Agreement between the Division of Emergency Management and Escambia County, to modify the Federally-Funded Subgrant Agreement - Flood Mitigation Assistance Grant Program, providing reinstatement of the Agreement, extending Project Number FMA-PJ-04-FL-2014-025 through September 30, 2019, and decreasing the Federal Share by $32,857.91, for the maximum amount payable under the Agreement to $608,868.98; and

B. Authorize the Chairman to sign the Agreement.
 
BACKGROUND:
The State of Florida Division of Emergency Management distributes grants for the mitigation of repetitive losses.  The State issues these funds to jurisdictions as subgrant recipients to be used for prevention of repetitive losses.  Escambia County, as a participant in the National Flood Insurance Program ("NFIP"), was qualified and eligible to receive these grant funds for the locations specified under the Agreement.  The grant fund is being administered by a DEM approved third party, Arcadis U.S., Inc., pursuant to the original Agreement that was approved by the Board of County Commissioners on November 5, 2015.  Since the time of the original execution of the Agreement, the cost of construction labor and materials have increased.  Modification Number 3 includes reinstatement of the Agreement, extension of the expiration date of the Agreement to September 30, 2019, and a decrease in the federal share by $32,857.91 for the maximum amount payable under the Agreement to $608,868.98.  The decrease in the Federal Share results from the State's requirement that the pre and post construction costs be reflected in the actual contractual costs.  As the projects are coming to a close, the previously projected pre and post construction costs were higher than the actual constractual costs and the Federal Share had to be decreased to keep in line with the requirements of the Grant Agreement.
BUDGETARY IMPACT:
This DEM Subgrant is federally funded and includes a cost share by each Grant Recipient.  Escambia County, as the sub-recipient, will be required to reimburse the Grant Recipients and then receive reimbursement for those expended funds from the State. Grant administration fees are also paid from the funds.
LEGAL CONSIDERATIONS/SIGN-OFF:
This Modification to the previously approved Agreement has been reviewed and approved as to form and legal sufficiency by Kia Johnson, Assistant County Attorney.

POLICY/REQUIREMENT FOR BOARD ACTION:
The Board requires its approval of Agreements and Modifications to approved Agreements.
IMPLEMENTATION/COORDINATION:
Upon final approval by the Board and the State, Escambia County Building Services Department will coordinate with the State of Florida and the approved third party administrator regarding the projects.
